HomeMy WebLinkAboutOrd 830 05/22/1962 ORDIN1\NCE NO 0 8'90 AN ORDI~JANCE AMENDING THE VILLAGE OF IviOUNT PROSPECT ZONING ORDINANCE RELATING TO PROPERry SITUATED ON THE WEST SIDE OF RAND ROAD AND NORfi OF BOB-O-LINK ROAD WHEREAS, the Board of Appeals of the Village of Mount Prospect, sitting as a Zoning Co~nission at a public meeting duly called and held according to law (Appeal No. '~-11 ), considered the question of reclassifying the real estate herein- after described from R-I, Single Family District to 2-3, Business District A~ID, WHEREAS, the President and Board of Trustees of the village of Mount Prospect, having considered the recommendation of said Zoning Board of Appeals, having agreed to vacate a portion of Elmhurst street as set forth in Ordinance No.1~q; and, WHEREAS, tme owners, as a condition of annexation have ~ed not to per- mit vehicle ingress or egress except offHand Road (U. S. 12) and have agreecfi te fence completely alGng the south and west liRes of the hereinafter described property tt bl~tk it. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That an ordinance entitled "An ordinance classifying, regulating and restric.ting the location of trades and industries and the location of buildings designed for speci- fied uses; regulating and limiting the height and bulk of build- ings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and sur- rounding such buildings; establishing the boundaries of districts for the said purposes, and prescribing penalties for the violation of its provisions," passed and approved December 4, 1923, and amendments thereto, and known as Ordinance No. 52, as amended by an ordinance known and cited as the Zoning Ordinance of Mount prospect, passed and approved May 2, 1944, and as subsequently amended to date hereof, be amended by reclassifying the following described real estate from R-l, Single Family District to B-3, Business District: (The legal description of said real estate is attached hereto and incorporated herein by reference as if here fully set out.) Section 2. That said real estate as reclassified shall be subject to all the limitations and conditions placed upon prop.- erties in the 8-3, BUSiness nis~~i~t ' as defined in the ordinances aforementioned. " Section 3. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to compllT with or who resists the enforcement of any of the provisions of this or- dinance shall be fined not more than One Hundred ($100) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. Legal Description attached to Ordinance No. 'l3g That part of the Southwest quarter of Section 21,!nwnskip 42 North, Range 11 East of the Third Principal Meridian lying South of the center line of Rand Road described as follows: Commencing at the Southwest corner or the East half of the Southwest quarter of said Section 2.1, thence North alQng the West line (!)f the East half of the Southwest quarter for a distance of lO~3.13 feet for a begirmlng, thence East alGag a line which makes an angle of 900 Q' with the last described line for a distance of 33.0 feet, thence Northeasterly along a line which makes an angle of 2.160 35' measured from West to Northeast for a distance of 316.80 feet to an inters.ction with the center line of Rand Road, thence NQrthwesterly along the center line of Rand Road, being a curved line convex to the Southwest and having a radius ot l5,62b.10 feet for a distance of 214.69 teet to the point of tangency or the curve, thence Northwesterly along the said center line of Rand Road for a distance or 148.13 feet to an intersection with the said West line of the East half of the Southwest quarter, thence South along the last described line for a distance of 1~.94 teet to an intersection with the Westerly right of way line of Rand Road, thence West along a line whieh makes an angle of 900 00' 30" with the last described line, measur.d from South to West for a distance ot l47.5B feet, thence South along a line and parallel to the said West line of the East half of the Southwest quarter tor a distance of 295.16 feet, thence East along a line and paral- lel to the North line of the Southwest ~uarter or the Southwest quarter of said Section 21 for a distance of 1~1.58 teet to an intersection with the said West line of the East half of the Southwest ~uarter, thence South along the last described line for a distance of 132.0 teet to the place of beginning, Cook county, Illinois; together with Lot 9 in Block 3, together with the North 130.66 feet of Elmhurst street, as recorded, in Prospect Meadows, a Subdivision of part of the West half of the Southwest quarter of Section 21, Town- ship 4.2 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois, recorded December 9, 1929 as Document No. 1~692921.
