HomeMy WebLinkAboutOrd 832 06/05/1962 10/6/5/62 ORDINANCE NO. 192 AN ORDINANCE GRANTING A VARIATION OF THE FRONT YARD SETBACK REQUIRID~ENT OF ~ROPERTY USED BY THE ILLINOIS RANGE COMPANY ON CENTRAL ROAD.t MOUNT FROS~ECT WhEREAS, the applicant Illinois Range Company, a corpor- ation, record title owner of the property hereinafter described, has applied for a variation to permit the addition of 25 x 113 foot building to an existing Building occupied by it on West Cen- tral Road, which variation would permit the applicant to build said addition to within one foot of its property line rather than to stay 25 feet from the property line as now required by the Zoning laws of the Village of Mount Prospect, and WHEREAS, the applican~ has agreed to make such building addition in accordance with plant submitted to the Village of Mount Prospect and attached to tnis ordinance and made a part hereof, and WfIEREAS, the Zoning Board of Appeals did conduct a pub- lic hearing on said matter (case No. 62-10) and did reject the application for said variation, and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have indicated that they do not agree with the recommendations of the Zoning Board of Appeals in the instant case and find that unless the variation is granted that practical hardships would be imposed upon the owner of the herein- after described property and that the variation, if granted, would not alter the essential character of the loeality and, therefore, find it to be to the best interests of the applicant as well as the Village of Mount Prospect that the variation sought be in fact granted, NOW, THEREFORE, BE IT uRDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That an ordinance entitled "An ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for speci- fied uses; regulating and limiting the height and bulk of build- ings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and sur- rounding such buildings; establishing the boundaries of districts for the said purposes; and prescribing penalties for the violation of its provisions," passed and approved December 4, 1923, and amendments thereto, and known as Ordinance No. 52, as amended by an ordinance known and cited as the Zoning Ordinance of Mount Prospect, passed and approved May 2, 1944, and as subsequently amended to date hereof, be varied so as to permit the applicant, namely, Illinois Range Company, to build an addition to their pre- sent building in accordance with the plans attached hereto and within one foot of the applicant's property line despite the 25 foot setback line required by the zoning laws of the Village on property described as follows: The West 200 feet of the East 450 feet of that part of the East half of the Southeast quarter of Section 33, Township 42 North, Range 11 East of the Third princi- pal Meridian, lying South of the right of way of the Chicago and Northwestern Railroad, on West central Road. Section 2. That the arorementioned real estate shall be subject to all other conditions and provisions placed upon it by the ordinances aforementioned. Section 3. of Mount Prospect is ting the erection of as set forth above. That the Building Department of the Village directed to issue a building permit permit- the addition to the aforementioned building Section 4. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this or- dinance shall be fined not more than One hundred ($100) Dol~rs for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Seotion 5. That this ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
