CAF/ 6/29/93 ORD INA/~CE NO. 4569 AN ORDINANCE GRANTING A MODIFICATION FROM THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY COMMONLY KNOWN AS STERGIOS SUBDIVISION WHEREAS, James Stergios (hereinafter referred to as Petitioner) has requested modifications from the Development Code (Chapter 16) of the Village of Mount for property commonly known as Stergios Subdivision (hereinafter after referred to as Subject Property) and legally described as follow: Lots 1, 2, 3 and 4 in Stergios Subdivision, being a resubdivision of Lot 3 (except the north 200 feet thereof) in C. A. Goelz' Prospect Gardens, being a subdivision of part of the West 1/2 of the West 1/2 of the Southeast 1/4 together with the East 2/3 of the Northeast 1/4 of the Southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, all in Cook County, Illinois; and WHEREAS, the Petitioner is requesting the following modifications from the Development Code (Chapter 16): 1. Allow a lot depth of 88 feet on each of the 4 lots within the Stergios Subdivision; 2. Allow a right-of-way width of 45 feet; 3. Allow the required sidewalk to be a width of 4 feet; 4. To defer installation of required public improvements until completion of construction in the subdivision. WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the requested modifications from the Development Code (Chapter 16) for the subject property; and WHE~, the Plan Commission has forwarded its recommendation, relative to the modifications requested herein, to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the President and Board of Trustees of the village of Mount Prospect do hereby grant the following modifications from the Development Code (Chapter 16) to the Subject Property: 1. Allow a lot depth of 88 feet on each of the 4 lots within the Stergios Subdivision; tergios Modifications Page 2 of 2 2. Allow a right-of-way width of 45 feet; 3. Allow the required sidewalk to be a width of 4 feet; SECTION THREE: Except for the modifications from the Development Code granted herein, all other requirements of said Development Code shall apply to the Subject Property, including the installation of all required public improvements. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
