MOtJN'll .PROSPECT WHEREAS, the applicant Trade Service Publication, Inc. desires to improve the property hereinafter legally described so that the rear portion of the building proposed will come within ten feet of their rear yard lot line, and vTI1EREAS, said property is zoned 1-1, and WfiliREAS, the zoning ordinance as applied to said prop- erty requires that no portion of any building built on said property be within 30 feet of the rear property line, and WHEREAS, the Board of Appeals did conduct a public hearing on said case (Case 02-38) on November 30, 1962 and did find that a hardship did exist due to the shape of the lot and that it was impractical to develope this property without the variation requested and that if the variation requested was granted the character of tile neighborhood would not be changed and did recommend that the variation be granted provided that construction on the building proposed be commenced within one year and be built in accordance with the testimony given at the public hearing; NOW, THERBFURE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, III ino is : Section 1. That an ordinance entitled "An ordinance classifying, regulating and restricting the location of trades and industries and the location of buildings designed for speci- fied uses; regulating and limiting the height and bulk for build- ings hereafter erected or altered, regulating and limiting the intensity of the use of lot areas and regulating and determining the area of yards, courts and other open spaces within and sur- rounding such buildings; establishing the boundaries of districts for the said purposes; and prescribing penalties for the violation of its provisions," passed and approved December 4,1923, and amendments thereto, and known as Ordinance No. 52, as amended by an ordinance known and cited as the Zoning Ordinance of Mount Prospect, passed and approved May 2, 1944, and as subsequently amended to date hereof, be varied so as to permit the construction of a building on the property legally described as follows: Lot 8 in Gleich's Industrial Park, a Subdivision of part of the West half of the Northeast quar- ter and part of the West half of the Southeast quarter of Section 12, Township 41 North, Range 11 East of the Third Principal Meridian, Cook County, Illinois, up to 10 feet from the rear yard line provided, however, that construction of the building proposed by the petitioner be com- menced on or before January 1, 1964 and be in substantial ac- cordance with the building proposed to be built as set forth in the testimony adduced before the Board of Appeals. Section 2. That the aforementioned real estate shall be subject to all other conditions and provisions placed upon it by the ordinances of the Village of Mouht Prospect. Section 3. That the Building Department of the Vil- lage of Mount Prospect is directed to issue building permits for the construction of said building provided application for the permit is made prior to January 1, 1964 and provided the build- ing proposed to be built is in accordance with the testimony adduced before the Board of Appeals on November 30, 1962, and provided that all other ordinances of the Village are fully com- plied with. Section 4. That any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One hundred ($100) Dollars for such offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 5. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
