TRUSTEE ¢O~4ENTS Trustee Hendricks asked who is responsible for the path located within the Kensington Center for Business, noting that overgrown shrubs could cause cyclist problems. Trustee Hendricks also expressed congratulations to the Chicago White Sox Baseball Team on winning the Division Championship. OLD BUSINESS ZBA 66-SU-93, 740 E. Rand Road (Courtesy Home ZBA 66-SU-93 Center) COURTESY/ An Ordinance was presented for second reading that MENARD'S would grant an amendment to the Planned Unit '740 E.RAND RD Development governing this property. The proposed amendment would allow a outside storage/sales area previously approved for self-storage facility. The Zoning Board of Appeals recommended granting the request by a vote of 6-0. It was proposed that the OrdinanQe be amended to allow for reasonable security lighting within the storage/sales area. Trustee Wilks, seconded by Trustee Hoefert, moved ORD.NO. 4592 for passage of Ordinance No. 4592, as amended AN ORDINANCE AMENDING ORDINANCE NO. 4142 AUTHORIZING A PLANNED UNIT DEVELOPMENT FOR PROPERTY COMMONLY KNOWNAS 740 E. EMILY'S An Ordinance was presented for first reading that SCHOOL would grant a variation to increase the existing lot 1400 CENTRAL RD coverage of 60.6% to 61.2% for an addition to the school. The Zoning Board of Appeals recommended granting this request by a vote of 5-0, with one abstention. It was noted that with the adoption of the new Zoning Ordinance (Chapter 14), the variation requested in this case is no longer necessary, therefore, the Petitioner has withdrawn his request. CHRISTIAN LIFE Christian Life College, 400 East Gregory Street COLLEGE: An Ordinance was presented for first reading that MODIFICATION would grant a modification from the Development FROM CH. 16 Code to waive the requirement to install the sidewalks required on Rand Road. The installation of these sidewalks is required in conjunction with the addition to the church presently underway. The Plan Commission recommended granting the modification as requested. A Resolution was presented that would authorize a Restrictive Covenant for Christian Life College, guaranteeing the installation of the required sidewalks at a future date to be determined by the Village. Trustee Hoefert~ seconded by Trustee Clowes, RES.NO. 40-93 moved for passage of Resolution No. 40-93 A RESOLUTION AUTHORIZING A RESTRICTIVE COVENANT FOR CHRISTIAN LIFE COLLEGE Upon r011 call: Ayes: Clowes, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried. Pursuant to a motion approved earlier'in the meeting the following two items were brought forward for consideration. ZBA 76-V-93, 601 North Main Street ZBA 76-V-93 The Petitioner is requesting variations to allow 601 N.MAIN the existing unimproved parking lot to be MOOSE LODGE imProved with a hard surface with the existing setbacks. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. Trustee Hoefert, seconded by Trustee Skowron, moved to concur with the recommendation of the Zoning Board of Appeals and grant the variations requested in ZBA 76-V-93. An Ordinance will be presented for first reading at the next regular meeting of the Village Board on October 19, 1993. Page 5 - October 5, 1993 RECAPTURE: An Ordinance was presented for first reading that ORCHARD FIELD SUB. would authorize a recapture agreement for connection BLUE JAY to the public improvements installed in conjunction with the Orchard Field Subdivision - Blue Jay Development. This Ordinance will be presented for second reading at the next regular meeting of the Village Board on October 19th. ~Trustee Corcoran arrived at the meeting at this point. SPECIAL SERVICE An Ordinance was presented for second reading AREA NO. 7 that proposed the creation of Special Service krea No. 7. Mayor Farley stated that the proposed Special Service Area Would tax some of the multi-family developments located on the 'south side of Mount Prospect in order to provide additional services such as building inspectors, additional police officers, etc. in order to bring these complexes into conformance with Village Codes. The Mayor also stated that adopting this Ordinance would allow for a Public Hearing, which would be held immediately after adoption of the Ordinance, as well as setting forth the steps required by law in order to establish a Special Service Area. The following landlords and/or residents spoke in opposition to adopting the proposed Ordinance: · James Sable, landlord in Jamestown Apartments Ms. Herman, Nortkwest Realtors Marilyn Hallihan, landlord 626 Dempster Street These people expressed concern about the creation of the Special Service Area and were concerned that if the Ordinance is passed the Village could not stop the process. Arthur Holtzman, attorney for the Village, stated the Village would be able to stop the process at any point prior to actually creating the Special Service Area if all other conditions of law apply. ORD.NO. 4596 Trustee .Corcoran, seconded by Trustee Hoefert, moved for passage of Ordinance No. 4596 AN ORDINANCE PROPOSING THE ESTABLISHMENT OF A SPECIAL SERVICE AREA IN THE VILLAGE OF MOUNT PROSPECT AND PROVIDING FOR A PUBLIC HEARING AND OTHER PROCEDURES IN CONNECTION THEREWITH Upon roll call: Ayes: Corcoran, Hoefert, Skowron, Wilks, Farley - Nays: Clowes, Hendricks Motion carried. PUBLIC HEARING Pursuant to proper legal notice having been SPECIAL SERVICE published in the Mount Prospect/Prospect Heights AREA NO. 7 Daily Herald on September 16, 1993, Mayor Farley called the Public Hearing to order at 8:40 P.M. The purpose of the Public Hearing was to consider the proposal to create Special Service ~_rea No. 7. Page 6 - October 5, 1993 Village Manager Janonis explained that there are several multi-family complexes that are in disrepair and additional inspections are necessary in order to follow up on complaints and to assure compliance with existing Codes, requiring additional inspectors or enforcement officers at an estimated cost of $300,000. There are also other services that would be rendered by the Human Services Department of the Village, such as multi-lingual personnel, financial assistance for low income residents, etc. Mr. Janonis also stated that it is anticipated that t~e budget for the entire Village will reflect a deficit of $1,000,000, therefore additional costs for specific areas would create an additional drain on the resources of the Village to provide specific services. Page 7 - October 5, 1993 Mayor Farley explained that, in accordance with law, objectors to the creation of the Special Service Area would have a period of 60 days in which petitions could be circulated and signatures obtained from at least 51% of the owners of record and at least 51% of the electors. The petitions would have to be submitted to the Village Clerk no later than Monday, December 6, 1993. Mayor Farley declared the Public Hearing closed at 11:05 P.M. DISPOSE OF An Ordinance was presented for first reading that PERSONAL PROPERTY would authorize the Village Manager to dispose of miscellaneous furniture and office equipment. The Village Board had previously approved Ordinance No. 4581, authorizing the sale of these items to the highest bidder, however, no bids were received. The Village Manager 'has received offers for the items from civic (charitable) organizations, therefore this Ordinance would permit the Village Manager to dispose of these items without the bidding process. CABLE TV RATES A Resolution was presented, as provided by law, which would establish the fact that Mount Prospect intends to regulate the rates charged by the Cable TV Franchisee, TCI of Illinois. RES.NO. 41-93 Trustee Hoefert, seconded by Trustee Corcoran, moved for passage of Resolution No. 41-93 A RESOLUTION TO PROVIDE FOR THE REGULATION OF BASIC SERVICE TIER RATES AND RELATED EQUIPMENT, INSTALLATION AND SERVICE CHARGES OFANY CABLE TELEVISION SYSTEM OPERATING IN THE VILLAGE OF MOUNT PROSPECT Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Hoefert, Skowron, Wilks Nays: None Motion carried.
