CAF/ 7/28/93 ORDINANCE NO. 4576 AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE (CHAPTER 16) OF THE VILLAGE CODE OF MOUNT PROSPECT RELATIVE TO PROPERTY COMMONLY KNOWN AS ELMHURST PLACE SUBDIVISION (1000 NORTH ELMHURST WHEREAS, Nauert Builders, Inc. (hereinafter referred to as Petitioner), has requested modifications from the Development Code (Chapter 16) of the Village Code of Mount Prospect for property generally located at 1000 - 1010 North Elmhurst Road (hereinafter referred to as Subject Property), legally described as follows: Lots 1, 2, 3, 4, 5, 6 and 7 in Elrahurst Place, being a Resubdivision of Lots 1, 2, 3 and 4 in Block 6, Wedgewood Terrace in the East 1/2 of the Southwest 1/4 of Section 27, Township 42 North, Range 11, East of the Third Principal Meridian, as per plat thereof recorded as Document No. 13732148, in the Office of the Recorder, Cook County, Illinois; and WHEREAS, Petitioner is requesting the following modifications from the Development Code: 1. To waive the requirement for public improvements on Meadow Lane and Oxford Place; and 2. To allow a zero foot (0') lot depth for Lot 6, due to the triangular shape of the lot. WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the proposed modifications from the Development Code for the Subject Property at their regular meeting on June 2, 1993; and WHERE/Lg, the Plan Commission has forwarded its recommendations to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BO;~RD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the President and Board of Trustees of the Village of Mount Prospect do hereby grant to the Subject Property the following modifications from the Development Code (Chapter 16): 1. To waive the requirement for public improvements on Meadow Lane and Oxford Place, subject to the signing of a Restrictive Covenant guaranteeing installation at a future date; and 2. To allow a zero foot (0') lot depth for Lot 6, due to the triangular shape of the lot. SECTION FOUR: This Ordinance shall be in full force and effect lmhurst Place Modifications Page 2 of 2 from and after its passage, approval and publication in pamphlet form in the manner provided by law.
