CAF 8/9/93 ORDINANCE NO. 4583 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 423 SOUTH PINE STREET WHEREJtS, Brian and Mary Delaney (hereinafter referred to as Petitioners) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 423 South Pine Street Lane (hereinafter referred to as Subject Property), legally described as: Lot 12 in block 3 in Prospect Park Subdivision Number 1, being a subdivision of the West Half of the North 60 rods of the Southwest Quarter of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioners seek a variation from Section 14.1102.D.4 to allow a six foot (6') service walk to encroach into the $ideyard setback, rather than the permitted 36" service walk; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 58-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 15th day of July, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 29th day of June, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 58-V-93 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, cook COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.1102.D.4 to allow an six foot (6') service walk in the required sideyard, rather than the permitted 36" service walk, subject to installation of a drainage system in the side yard as recommended by the Engineering Division of the Village. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 BA 58-V-93 Page 2 of 2 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
