AN ORDINANCE GRANTING A SPECIAL USE FOR PROPERTY
LOCATED AT 107 WEST PROSPECT AVENUE
WHEREAS, Bruce W. Biedar (hereinafter referred to as Petitioner)
has filed a petition for a Special Use with respect to property
located at 107 West Prospect Avenue (hereinafter referred to as
Subject Property); and
WHEREAS, the Subject Property is legally described as follows:
Lots 18 and 19 in busse's Resubdivision on Lots 1 and 6
inclusive in Block 4, also of Lots 2 and 3 in Block 5, all
of Block 6, Lots 13 to 24 inclusive in Block 7, and Lots
17 to 20 in Block 8, all in Meier's Addition to Mount
Prospect, being a subdivision in the Northwest Quarter of
Section 12, Township 41 North, Range 11, East of the Third
principal Meridian, in Cook County, Illinois
and
WHEREAS, Petitioner seeks a Special Use as required in Section
14.1101.C.5 to allow the installation of a roof-mounted satellite
antenna in a B-3 (Business Retail and Service) District; and
WHEREAS, a public hearing was held on the request for Special Use,
being the subject of ZBA 83-SU-92, before the Zoning Board of
Appeals of the Village of Mount Prospect on the 10th day of
December, 1992, pursuant to proper legal notice having been
Published in the Mount Prospect Herald on the 24th day of November,
1992; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendations to the President and Board of Trustees to grant the
Special Use being the subject of ZBA 82-SU-92.
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have given consideration to the request herein and
have determined that the same meets the standards of the Village
and that granting the Special Use requested in ZBA 82-SU-92 would
be in the best interest of the public.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated
as findings of fact by the President and Board of Trustees of the
Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of
Mount Prospect do hereby grant a Special Use to the subject
property to permit a roof-mounted satellite antenna, subject to the
Petitioner providing screening, as approved by the Director of
Planning of the Village.
SECTION THREE: This Ordinance shall be in full force and effect

from and after its passage, approval and publication in pamphlet
form in the manner provided by law.
