ORDINANCE NO. 9' / "
AN ORDINANCE DIRECTING THE SAIB OF CERTAIN REAL PROPERTY
OWNED BY THE VILLAGE OF MOUNT PROSPECT AND DIRECTING THE
MAKING OF A CONTRACT AND THE CONVEYANCE OF SAID PROPERTY
TO JOHN O. McCABE DOING BUSINESS AS McCABE REALTY OR SUCH
OTHER PARTY AS HE MAY DIRECT.
WHEREAS, the Village of Mount prospect on April 9, 1963
passed and approved Ordinance No. 901, which ordinance authorized
the sale of the following described real estate:
Lot 4 in Maple Crest Subdivision, being a Subdivision
of part of the Northeast quarter of Section 34,
Township 42 North, Range 11, East of the Third
Principal Meridian, according to the plat recorded
October 28, 1958 as Document #17360466, Cook County,
Illinois.
in accordance with Section 11-76-2 Chapter 24 of the Illinois
Revised Statutes (1961 edition), and
WHEREAS, in compliance with said ordinance and the
statutes ot the S+ate ot Illinois made and provided, the Village
Clerk did cause pUblic legal notice advertising tor competitive
bids for said property to be given, and
WHEREAS, said bids were duly opened at the regular
meeting of the President and Board of Trustees of the Village
of Mount Prospect in compliance with said ordinances and
statutes, and
WHEREAS, the highest and best bid received by said
village for said real estate at said time and in accordance
with Ordinanoe No. 901 was that of John O. McCabe doing
business as McCabe Realty in the amount of Forty Two Thousand
Six Hundred Dollars ($42,600.00) which amount was in conformity
with appraisal report of the village, and
WHEREAS, said property is a vacant parcel of real estate
having a frontage of approximately 257 feet upon and along the
southwest side of Rand Road and having an area of approximately
one aore, said property being located 292 feet northwesterly
of the intersection of Rand Road and Highland Avenue, Mount
Prospect, Illinois, and
WHEREAS, said property is no longer necessary approp-
riately or useful to the Village of Mount Prospect or its
residents,
NOW, THEREFORE, BE IT ORDAINED by the President and
Board of Trustees of the Village of Mount Prospect, Cook County,
Illinois:
Section 1: That the bid of John o. McCabe doing business
as McCabe Realty heretofore described in the amount of Forty
Two Thousand Six Hundred Dollars ($42 600.00) be and is hereby
accepted and that James King Village ~reasurer is authorized
to deposit an earnest money check payable to the village in
the amount of Four Thousand Two Hundred S1.xty Dollars ($4,260.00)
and that John O. McCabe doing business as McCabe Realty is
hereby awarded the property afore.escribed.
Section 2: That the Village President and Village
Clerk are hereby authorized to sign the real estate contract
attached hereto and made a part hereof as is fully set forth
as well as a deed of conveyance to said JOhn O. McCabe doing
business as McCabe Realty or any person whom he shall desig-
nate in writing to receive title, and to sign any and all
other documents deemed necessary to transfer of title to the
above described property to the said John O. McCabe doing
business as McCabe Realty or said person designated, upon
receipt of the full purchase price sited herein.
Section 3: ~is ordinance shall be in full force
and effect from and after its passage and approval according
to law.
