CAF/ 2/23/93 ORDINANCE NO. 4525 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS1810 PHEASANT TRAIL WHEREAS, Christa and Steven Leyendecker (hereinafter referred to as Petitioners) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 1810 Pheasant Trail (hereinafter referred to as Subject Property), legally described as: Lot 496 in Elk Ridge Villa Unit No. 6, being a Subdivision of Lot 1 and part of Lot 2 in Edward Busse's Division in the Southeast Quarter of Section 15, Township 41 North, Range 11, East of the Third Principal Meridian, according to the Plat of said Elk Ridge Villa Unit No. 6 registered in the Office of the Registrar of Titles of Cook County, Illinois, on April 19, 1965, as Document Number 22043212; and WHEREAS, Petitioners seek a variation from Section 14.1203 of Chapter 14 of the Village Code of Mount Prospect to allow a faloor area ratio of .35, instead of the maximum allowed .30, to permit the construction of a room addition; and WHEREAS, a public hearing was held on the variation requested, being the subject of ZBA Case No. 2-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 28th day of January, 1993 pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 12th day of January, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation requested in ZBA 2-V-93 and have determined that it would be in the best interests of the Village of Mount Prospect to grant said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a variation from Section 14.1203 to allow a Floor Area Ratio of .35, rather than the maximum .30 permitted. SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect BA 2-V-93 Page 2 of 2 from and after its passage, approval and publication in pamphlet form in the manner provided by law.
