CAF 3/29/93 ORDINANCE NO. 4532 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 805 NEWBERRY LANE WHEREAS, Ronald and Sylvia Alfirevic (hereinafter referred to as Petitioners) have filed an application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 805 Newberry Lane (hereinafter referred to as Subject Property), legally described as: Lot 4 in Resubdivision of Lot B, Brickman Manor, First Addition Unit Number 5, being s subdivision in the South Half of Section 26,Township 42, North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois; and WHEREAS, Petitioners seek variations from Section 14.102.2 to allow an interior side yard setback of 2.25 feet, instead of the minimum allowed 5 feet, and a variation from Section 14.201.1 to allow an accessory structure to within 1.63 feet of a principal structure, instead of the minimum 10 feet required, for the purpose of allowing a shed; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 12-V-93 before the Zoning Board of Appeals of the .Village of Mount Prospect on the 25th day of February, 1993, pursuant to due and proper notice thereof published in the Mount Prosoect Herald on the 9th day of February, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 12-V-93 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property variation from Section 14.102.2 to allow an interior side yard setback of 2.25 feet, rather than the minimum requirement of 5', and a variation from Section 14.102.1 to allow an accessory structure within 1.63 feet from a principal structure, instead of the minimum 10 feet required, in order to permit a shed. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 BA 12-V-93 Page 2 of 2 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
