CAF 4/6/93 ORDINANCE NO. 4533 AN ORDINANCE GRANTING VARIATIONS FOR PROPERTY LOCATED AT 717 NORTH FOREST AVENUE WHEREAS, Wieslaw Telichowski and G. Maron-Oswiecimska (hereinafter referred to as Petitioners) have filed an application for variations from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 717 North Forest Avenue (hereinafter referred to as Subject Property), legally described as: Lot 2 of a Resubdivision of Lots 6 to 10, inclusive in Block 5; Lots 1 to 10 inclusive in Block 8 and all of vacated alleys (as per plat recorded December, 1954 as Document 16103192) lying south of adjoining said lots in said Blocks in Landview Highlands, a Subdivision of the Northwest 1/4 of the Northwest 1/4 and the Northeast 1/4 of the Northwest 1/4 of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioners seek variations from Section 14.102.B.2 to allow a one foot (1') interior sideyard setback, instead of the minimum allowed 5 feet and a variation from Section 14.3016.A.3 to allow a driveway width of twenty-two feet six inches (22' 6"), instead of the maximum allows 21 feet; and WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 15-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 25th day of March, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 9th day of March, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variations being the subject of ZEA 15-V-93 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property variations from Section 14.102.B.1 to allow a three foot (3') interior sideyard setback, instead of the minimum allowed 5 feet, and a variation from Section 14.3016.A.3 to allow a driveway width of twenty-two feet six inches (22' 6"), instead of the maximum allows 21 feet. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.604 BA 15-V-93 Page 2 of 2 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
