CAF/ 4/14/93 ORDINANCE NO. 4535 AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY GENERALLY LOCATED AT 1026 LINNEMAN ROAD WHEREAS, Susan Flosi Moylan (hereinafter referred to as Petitioner) has requested modifications from the Development Code (Chapter 16) of the Village of Mount for property generally located at 1026 Linneman Road (hereinafter referred to as Subject Property) and legally described as follows: Lots 1 and 2 in Patty Sue Subdivision being a Subdivision of the East 172.23 feet of the West 788.95 feet of the North 126.46 feet of the South 393.68 feet of the Northeast Quarter of Section 14, Township 41, North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, the Petitioner is requesting that the requirements for sidewalks, curb and gutter, street lighting, street pavement and width be waive for the proposed subdivision; and WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the proposed modifications from the Development Code (Chapter 16) for the Subject Property at their regular meeting on March 17, 1993; and WHEREAS, the Plan Commission has forwarded its recommendations relative to the modifications requested herein to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That the President and Board of Trustees of the Village of Mount Prospect do hereby required that all required public improvements shall be installed at the subject site, but allow for such installation at the time of Linneman Road improvements. Such installation shall be guaranteed by the Petitioner through a Restrictive Covenant recorded against the Subject Property. SECTION THREE: This Ordinance shall be in full force and effect 026 Linneman Road Modifications from and after its passage, approval and publication in pamphlet form in the manner provided by law.
