TO ORDER Mayor Farley called the meeting to order at 7:30 P.M. INVOCATION APPROVAL OF MINUTES Trustee Wilks, seconded by Trustee Clowes, APPROVE moved to approve the ·minutes of the regular MINUTES meeting of the Mayor and Board of Trustees held July 6/ 1993. FINANCIAL REPORT Trustee Clowes, seconded by Trustee Wilks, moved to accept the financial report through June 30, 1993, subject to audit. M~YOR'S REPORT PRESENTATION: Mayor Farley announced the winner of the 1993 Tom TOM ABRAMS Abrams Trophy for participation in the July 4th TROPHY: ST.PAUL parade as St. Paul's Lutheran Church and School. LUTHERAN CHURCH Mayor Farley presented the trophy for outstanding & SCHOOL participation in the parade to Pastor Tucker and Joyce Weitrechi. FARMERS Mayor Farley introduced Gall Meyers, who has MARKET volunteered to organize the 1993 Farmers Market, due to the fact that the Jaycees are longer involved with this project. Ms. Meyers stated that the Farmers Market would begin Sunday, July 25th with the last day being October 17th and that any profits realized from this event would be donated to charity. COMMUNICATIONBANDPETITIONS - CITIZENS TO BE HEARD None. TRUSTEE COMMENTS FLOOD RELIEF Trustee Clowes gave the address and phone numbers of both the American Red Cross and Salvation Army for donations of any kind for the flood victims along the Mississippi River. OLD BUSINESS ZBA 28-Z-93 ZBA 28-Z-93, 1699 Wall Street 1699 WAT.I. STREET A request was presented from the Petitioner asking that this case be withdrawn from consideration, which was done. ZBA 40-V-93 ZBA 40-V-93, 2004 East Woodview 2004 WOODVIEW An Ordinance was presented for first reading that would grant a variation to allow interior side yards of 2'10" on the west and 3' on the east, in order to construct handicap ramps onto the deck. The Zoning Board of Appeals recommended granting this request by a vote of 6-0. Trustee wilks, seconded by Trustee Corcoran, moved to waive the rule requiring two readings of an Ordinance. Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Wilks Nays: None Motion carried. ORD.NO. 4572 Trustee Wilks, seconded by Trustee Corcoran, moved for passage of Ordinance No. 4572 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 2004 E. WOODVIEW Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Wilks Nays: None Motion carried. Page 2 - July 20, 1993 ZBA 44-V-93, 628 Bob-O-Link ZBA 44-V-93 An Ordinance. was presented for first reading that 628 BOB-O-LINK would grant a variation to allow a front yard setback of 20 feet, instead of the minimum of 30 feet, in order to allow an existing porch to remain. Also requested is a variation to allow a second driveway to be added off Forest Avenue. The Zoning Board of Appeals recommended granting these requests by a vote of 6-0. This Ordinance will be presented August 3rd for second reading. ZBA 45-Z-93, i022 Linneman'Road ZBA 45-Z-93 An Ordinance was presented for first reading that 1022LINNEMANRD would rezone the subject property from R-X to R-1 (Single Family). The Zoning Board of Appeals recommended granting this request by a vote of 6-0. This Ordinance will be presented for August 3rd for second reading. Patty Sue Subdivision, 1026 Linneman Road PATTY SUE The Petitioner is subdividing this parcel into SUBDIVISION two lots of record for single family homes. The Plan Commission reviewed this plat and recommended approval. Trustee Corcoran, seconded by Trustee Wilks, moved to authorize the Mayor to sign and Clerk to attest his signature on the Patty Sue Plat of Subdivision and related documents in order to create two lots of record and required dedication of the public right-of-way. Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Wilks Nays: None Motion carried. A Resolution was presented that authorized RESTRICTIVE entering into a Restrictive Covenant, guaranteeing COVENANT installation of certain public improvements .at a future date to be determined by the Village. Trustee Corcoran, seconded by Trustee Clowes, RES.NO. 31-93 moved for passage of Resolution No. 31-93 A RESOLUTION AUTHORIZING EXECUTION OF A RESTRICTIVE COVENANT FOR PROPERTY GENERALLY KNOWN AS PATTY SUE SUBDIVISION (1026 LINNEMAN ROAD) Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Wilks Nays: None Motion Carried. NEW BUSINESS Elmhurst Place Subdivision ELMHURST PLACE The Petitioner is requesting a modification SUBDIVISION: from the Development Code as to lot depth and MODIFICATIONS to waive the requirement to install certain FROM DEVELOPMENT public improvements. The Plan Commission recommended granting these requests. Page 3 - July 20, 1993 A resident of the area stated that the main concern of the neighbors relative to this project is drainage. He also stated that the residents do not want sidewalks in this neighborhood and asked the Board to waive that requirement. Trustee Clowes, seconded by Trustee Corcoran, moved to concur with the recommendation of the Plan Commission and grant the requested modifications from the Development Code. Upon roll call= Ayes:Clowes, Corcoran, Hendricks, Wilks Nays: None Motion carried. An Ordinance will be presented for first reading at the next meeting of the Village Board On August 3rd. FAIR HOUSING The 1992 Fair Housing Report was presented. It was REPORT: 1992 noted that the Plan Commission had reviewed the report and that no complaints had been received in 1992. Trustee Wilks, seconded by Trustee Clowes, moved to concur with the recommendation of the Plan Commission and accept the 1992 Fair Housing Report as submitted. Upon roll call: Ayes: Clowes, Corcoran, Hendricks, wilks Nays: None Motion carried. VILLagE MANAGER'S REPORT Village Manager Michael E. Janonis presented bid results for various items. RESTROOM The following bids were received to improve the FACILITIES restroomfacilities on the 2nd floor of the Village VILLAGE HALL: Hall to meet the requirements of.theAmericans with ADA Disabilities Act: Bidder Amoun~ The Dubs Company, Inc. $ 31,400.00 Wahlburg Construction Company 33,500.00 Nicholas & Associates 35,401.00 DUBS CO. Trustee Corcoran, seconded by Trustee Wilks, moved to concur with the recommendation of the administration and accept the low qualified bid submitted by the Dubs Company, Inc. to improve the restroom facilities on the 2nd floor of the Village Hall to comply with the ADA requirements at a cost not to exceed $31,400.00 Upon roll call: Ayes: Clowes, Corcoran, Hendricks, Wilks Nays: None Motion carried. Page 4 - July 20, 1993 The following bids were received for the MAPLE STREET reconstruction of Maple Street between RECONSTRUCTION Northwest Highway and Central Road: Bidder Amount Arrow Road Construction $209,355.90 J. A. Johnson Paving 313,776.70 Trustee Wilks, seconded by Trustee Corcoran, ARROW ROAD moved to concur with the recommendation .of the CONSTRUCTION .administration to accept the iow qualified bid submitted by Arrow Road Construction for the 'reconstruction of Maple Street between Northwest Highway and Central Road at a cost not to exceed $209,355.90. Upon roll call= Ayes= Clowes, Corcoran, Hendricks, Wilks Nays= None Motion carried. Mr. Janonis presented a request to increase the INCREASE the contract with Arrow Road, previously accepted CONTRACT= for the parking lot improvement at Fire Station FIRE DEPT. '%2 on Golf Road. It was noted that additional PARKING LOT work was required which increased the total cost STATION #2 by $6,921.70. Trustee Corcoran, seconded by Trustee Wilks, moved to authorize an increase to the contract with Arrow Road Construction for the reconstruction of the parking lot for the Fire Station #2 by $6,921.70. Upon roll call= Ayes: Clowes, Corcoran, Hendricks, Wilks Nays: None Motion carried. A requestwas presented for a field change for the FIELD Rogers Corporate Park to allow limited retail sales CHANGE: for M. Hyman & Son. It was noted that this sale ROGERS would be toclear the various sites and would not CORPORATE be an on-goingevent. PARK Trustee Wilks, seconded by Trustee Corcoran, moved to grant a field change for Rogers Corporate Park and allow H. Hyman & Son to conduct limited retail sales in this industrial park.
