CAF/ 9/28/93 ORDINANCE NO. 4593 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN ST. EMILY SCHOOL, 1400 EAST CENTRAL ROAD WHEREAS, the Archdiocese of Chicago (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property located at 1400 East Central Road (hereinafter referred to as Subject Property), and legally described as: That part of the east 1/2 of the west 1/2 of the Southeast 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, described as follows: commencing at a point on the east line of the west 1/2 of the east 1/2 of the southeast 1/4 of said Section 35, which is 872.13 feet north of the southeast comer of said west 1/2 of the east 1/2 of the southeast 1/4 of said Section 35; thence west at right angles to the east line of said west 1/2 of the east 1/2 of the southeast 1/4 of said Section 35, a distance of 820 feet to the point of beginning of the tract herein described; thence continuing west on said line 500.15 feet, more or less, to the west line of the east 1/2 of the west 1/2 of the southeast 1/4 of said Section 35; thence south on said west line 863.07 feet to the southwest corner of said east 1/2 of the west 1/2 of the southeast 1/4 of said Section 35; thence east along the south line of said Section 35 a distance of 500.60 feet, more or less, to a point 820 feet west of the southeast corner of the west 1/2 of the east 1/2 of the southeast 1/4 of said Section 35; thence north 866.52 feet, more or less, to the point of beginning, situated in the county of Cook in the State of Illinois; and Lot 4 (except the south 211 feet thereof) in C. A. Goelz' Prospect Gardens, being a subdivision of the west 1/2 of the west 1/2 of the southeast 1/4, together with the east two-thirds of the north three-quarters of the northeast 1/4 of the southwest 1/4 of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioner requests a variation from Section 14.1101.E to increase the existing non-conforming lot coverage of 60.6% to 61.2% in order to allow two additions to the school; and WHEREAS, a public hearing was held on the variation being the subject of ZBA Case No. 68-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 9th day of September, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 24th day of August, 1993; and WHEREAS, the Zoning Board of Appeals did consider the request stated herein and have forwarded their recommendation to the President and Board of Trustees of the Village of Mount Prospect. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. BA 68-V-93 Page 2 of 2 SECTION 'I'VVO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a variation from Section 14.1101.E to allow a lot coverage of 61.2%. SECTION THREE: Except for the variation granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
