CAF/ 9/28/93 ORDINANCE NO. 4595 AN ORDINANCE GRANTING A MODIFICATION FROM THE DEVELOPMENT CODE (CHAPTER 16) FOR PROPERTY LOCATED AT 400 EAST GREGORY STREET CHRISTIAN LIFE COLLEGE WHEREAS, Christian Life College has requested a modification from the Development Code (Chapter 16) of the Village of Mount to waive the requirement to install sidewalks required along Rand Road, in conjunction with the improvement to the Christian Life College; and WHEREAS, the Plan Commission of the Village of Mount Prospect did consider the proposed modification from the Development Code (Chapter 16) for the Subject Property, legally described as follows: The South 1/2 of the Southeast 1/4 of the Northeast 1/4 of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian, lying Westerly of Rand Road, except the North 229.93 feet, as measured at right angles and except that part thereof dedicated for street purposes as per Document No. 18617987, in Cook County, Illinois; and WHEREAS, the Plan Commission has forwarded its recommendation relative to the modification from the Development Code being the subject of this Ordinance to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have determined that the best interests of the Village would be served in granting the modification as requestedl NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That a modification from the Development Code (Chapter 16) is hereby granted to the Subject Property to waive the requirement to install sidewalks along Rand Road, which sidewalks are required in conjunction with the improvement being made to the property, provided that the Petitioner enter into a Restrictive Covenant guaranteeing the installation of the required sidewalks at some future date to be determined by the Village. SECTION THREE: This Ordinance shall be in full force and effect from and after its hristian Life College Page 2 of 2 passage, approval and publication in pamphlet form in the manner provided by law.
