CAF 10/11/93 ORDINANCE NO. 4598 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY LOCATED AT 601 NORT.H MAIN STREET VVHEREAS, the Loyal Order of Moose Lodge ~860 (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 601 North Main Street (hereinafter referred to as Subject Property), legally described as: The South 2'15 feet of the West 575.43 feet of the Northwest 1/4 of the Northeast 1/4 of Section 34, Township 42 North, Range 11, East of the Third Principal Meridian (excepting from the aforesaid tract the East 218.28 feet thereof and also excepting that part taken for streets) all in Cook County, Illinois and WHEREAS, Petitioner seeks variations from Section 14.2002.E to allow the following: 1. A two foot (2') setback from the right-of-way along Main and Highland Streets, instead of the minimum required of 30 feet; 2. A two foot (2') setback from the interior lot line, instead of the minimum required of 10 feet; and 3. A ten foot (10') setback from the adjacent residential area to the rear, instead of the minimum required of 20 feet. The variations requested herein would permit the Petitioner to replace the existing parking lot in the same location. WHEREAS, a public hearing was held on the variations requested being the subject of ZBA Case No. 76-V-93 before the Zoning Board of Appeals of the Village of Mount Prospect on the 23rd day of September, 1993, pursuant to due and proper notice thereof published in the Mount Prospect Herald on the 7th day of September, 1993; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 76-V-93 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variations. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property variations from Section 14.2002.E as follows: 1. Five feet (5') from the right-of-way along Main Street with an area from the northernmost driveway approximately 33 feet south to the existing planter box which shall be 2 feet (2') instead of the required of 30 feet. Four feet (4') from the right-of-way along Highland Street with the exception of a six foot (6') section at the western comer which will be two feet (2') instead of the minimum required of 30 feet. 3. Two feet (2') along the interior side yard instead of the minimum required 10 feet. 4. Ten feet (10') along the rear property line instead of the minimum required 20 feet. All as shown on Exhibit "A" attached hereto and hereby made a part hereof. SECTION THREE: Except for the variations granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
