HomeMy WebLinkAboutOrd 980 05/05/1964 tJ" ORDINANCE NO. r to AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT ZONING ORDINANCE RELATING TO PROPERTY COMMONLY KNOWN AS THE NORTHERN ILLINOIS GAS CO. PROPERTY ON FOUNDRY EAST OF RAND ROAD WHEREAS, the Board of Appeals of the Village of Mount Prospect, sit- ting as a Zoning Commission at a public meeting duly called and held accord- ing to law (Appeal No. 64-15) considered the question of reclassifying the real estate hereinafter described from R-l to I-I, AND WHEREAS, the Pre sident and Board of Tru stee s of the Village of Mount Prospect, having considered the recommendation of said Zoning Board of Appeals, find and believe that the highest and best use of said real estate is that of I-I, NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1: That an ordinance entitled lIZoning Ordinance of Mount Prospectll passed and approved April 2, 1963, and known as Ord. #898 and as subsequently amended to date hereof, be amended by reclassifying the following described real estate from R-l to I-I: The West half of the West half of the Northwest quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian, AL S 0 The East 75 feet of the South 110 feet of the Southeast quarter of the Northeast quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridian, AL S 0 The North 100 feet of that part of the Northeast quarter of the Southeast quarter of Section 34 aforesaid lying easterly of the centerline of Rand Road. Section 2: That said real estate as reclassified shall be subject to all the limitations and conditions placed upon properties in the I-I District as defined in the ordinances aforementioned. Section 3: That any person, firm or corporation who violates, dis- obeys, omits, neglects or refuses to comply with or who resists the enforce- ment of any of the provisions of this ordinance shall be fined not more than One Hundred ($100.00) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4: That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law. Page 2 RESTRICTIVE COVENANT NORTHERN ILLINOIS GAS COMPANY, a corporation of Illinois, for itself, its successors and assigns does hereby covenant with the VILLAGE OF MOUNT PROSPECT, Illinois, a municipal corporation of Illinois, that the following described property, to wit: The West 1/2 of the West 1/2 of the Northwest Quarter of Section 35, Township 42 North, Range 11 East of the Third Principal Meridian Also The East 75 feet of the South 110 feet of the Southeast Quarter of the Northeast Quarter of Section 34, Township 42 North, Range 11 East of the Third Principal Meridi an Also The North 100 feet of that part of the Northeast Quarter of the Southeast Quarter of Section 34, aforesaid, lying easterly of the center line of Rand Road, all in Cook County, Illinois, nor any portion thereof will not be used for the following purpo se s: (A) Building material storage yard. (B) Carting, express, hauling or storage yard. (e) Coal, coke or wood yard. (D) Lumber yard. This covenant shall run with the land and be binding upon the parties and all persons claiming thereunder and shall be construed as a real covenant running with the land. This covenant shall run to the benefit of the Village of Mount Prospect which may enforce its terms by an appropriate form of action in law or equity in any court of competent jurisdiction.
