HomeMy WebLinkAboutOrd 983 05/19/1964 ~ ORDINANCE NO. 983 :1 Ii :1 II AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT'S II ZONING ORDINANCE BY GRANTING A VARIATION IN FRONT YARD SET- i: BACK AND REAR YARD SET-BACK TO PROPERTY OWNED BY THE VILLAGE II AND LOCATED AT 11 SOUTH PINE STREET II WHEREAS, the Board of Appeals of the Village of Mount Prospect, conducted a public meeting called and held according to law (Appeal No. 64-20), to consider the question of granting a variation of the property hereinafter described; and WHEREAS, said real estate is zoned I-I Industrial by the Mount Prospect Zoning Ordinance, which classification would prevent the proposed use to be made of the property; and WHEREAS, the Village is desirous of placing its public works building within 15 feet from the front property line and within 5 feet of the rear property line so as to observe a 15 ft. front yard set-back and a 5 ft. rear yard set-back which set-back requirements are not permitted in the I-I classification of the Mount Prospect Zoning Ordinance; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the recommendation of the Zoning Board of Appeals, and based upon the foregoing believe it to be to the best interest of the Village that the variation be granted. NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That an ordinance entitled "Zoning Ordinance of Mount Prospect" passed and approved April 2, 1963, and known as Ordinance No. 898, as amended to date hereof be varied so as to permit the construction of a public works building within 15 feet of the front property line so as to observe a front yard set-back of 15 feet and within 5 feet of the rear property line so as to observe a 5 ft. rear yard set-back on property legally described~s follows: Lots 13 through 16, inclusive, and lot 17 except the north 22 feet thereof, all in block 2 in Busse and Wille's resubdivision in Mount Prospect, in the west half of Section 12, Township 41 North, Range 11, east of the Third Principal Meridian in Cook County, Illinois. Section 2. That said real estate shall be subject to all other limitations and conditions placed upon the property by the Zoning ordinances of the Village of Mount Prospect. Section 3. That any person, firm or corporation who vio- lates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100.00) Dollars for each offense, and each day that a violation is per- mitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
