HomeMy WebLinkAboutOrd 991 08/18/1964 ORDINANCE NO. 991 AN ORDINANCE AMENDING THE VILLAGE OF MOUNT PROSPECT'S ZONING ORDINANCE BY AUTHORIZING A SPECIAL USE PERMIT FOR A THEATER (INDOOR) AT THE RANDHURST SHOPPING CENTER '':"''M~ WHEREAS, the Board of Appeals of the Village of Mount Prospect, sitting as a Zoning Commission at a public meeting duly called and held according to law (Appeal No. 64-31), considered the question of gran~rng a special use permit for an indoor theater on real estate hereinafter described; and WHEREAS, said Zoning Board of Appeals did recommend same and did make all required findings called for by the ordinance of the Village of Mount Prospect; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have considered the recommendations of said Board of Appeals and believe that a special use permit as requested should be granted for said real estate, NOW, THEREFORE, BE IT ORDAINED by the President and Board of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That the "Zoning Ordinance of the Village of Mount Prospect" passed and approved April 2, 1963, and known as Ordinance No. 898, be amended so as to permit a special use for an indoor theater to be estab- lished on the following described real estate: That part of the West 1/2 of the Southeast 1/4 of Sec. 27, Twp. 42 N, Range 11, East of the 3rd P.M., bounded by a line described as follows: Commencing at a point on the North line of the West 1/2 of said Southeast 1/4 976.40 ft. East of the Northwest corner thereof; thence South parallel with the West line of the West 1/2 of said Southeast 1/4 169.50 ft. for a place of beginning; thence con- tinuing South along said parallel line 147 ft. to a point of curve; thence South and East along a curved line, tangent with the last described line convex to the Southwest and having a radius of 35 ft. 54.98 ft., arc measure; thence East tangent with the last described curved line, 66 ft; thence North parallel with the West line of the West 1/2 of said Southeast 1/4, 182 ft; thence West 101 ft. to the place of beginning (hereinafter called the "Theater Site"). Section 2. That the Building Commissioner of the Village be and is hereby authorized to issue said special use permit subject to the applicant's compliance with all pertinent laws of the State of Illinois and the Village of Mount Prospect. Section 3. That any person, firm or corporation who violates, dis- obeys, omits, neglects or refuses to comply with or who resists the enforce- ment of any of the provisions of this ordinance shall be fined not more than One Hundred ($lOO.) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and effect from and after its passage, approval and publication, according to law.
