HomeMy WebLinkAboutOrd 1009 01/05/1965 ORDINANCE NO. /-R tJ 1 AN ORDn~ANCE AMENDING THE VILLAGE OF MOUNT PROSPECT'S ZONING ORDINA'NCE RELATING TO PROPERTY LOCATED AT 1700 WEST CENTRAL ROAD (RKF'ERRED TO AS THE AMER IeAN LEGION PROPERJY). WHEREAS, the Board of Appeals of the Village of Mount Prospect, sitting as a Zoning Commission at a public meeting duly called and held according to law (Appeal No. 64-38), considered the question of reclassifying the real estate herein- after described from B-3 to I-l; and WHEREAS, the evidence disclosed before the Board of Appeals of the Village of Mount Prospect, sitting as a Zoning Commission, did indicate that at the time the B-3 zoning classification was accorded to the property it was restricted by documents of public record in such a manner as to indicate that said B-3 classifica- tion would automatically terminate upon transference of title or a change in the proposed use as the American Legion Hall, which facts were known or should have been known by the present property owner; and WHEI~EAS, the Board of Appeals find that there was no reliance by the present owner on the B-3 zoning district classifica- t ion; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect, having considered the reconnnendation of said Zoning Board of Appeals, find and believe that the highest and best use of said real estate is that of I-l; NOW, THEREFORE, BE IT ORDAINED by the President and Beard of Trustees of the Village of Mount Prospect, Cook County, Illinois: Section 1. That an ordinance entitled nZoning Ordinance of Moun~ Prospect" passed and approved April 2, 1963, and known as Ordinance No. 898, and as subsequently amended to date hereof, be amended by reclassifying the following described real estate f'rom B-3 to 1-1: The East 100 ft. of the West 800 ft. of South 208 fto of' Lot D in Kirchhoff's Sub. of the Northeast 1/4 of' the Northeast 1/4 of See. 10 and East 1/2 of the Northwest 1/4 of the Northeast 1/4 of Sec. 10 and the Northwest 1/4 of the Northwest 1/4 of Sec. 11 and the North 10 ch. of' the Southwest 1/4 of the Northwest 1/4 of' Sec. 11 all in Township 41 North, Range 11, East of the 3rd P.M. and the South 1/4 of the South 1/4 of' Sec. 33, that part of the West 1/2 of the Northwest 1/4 South of RR of Sec. 33, the Northwest 1/4 of Southwest 1/4 of Sec. 33, that part of the Northeast 1/4 of the Southwest 1/4 south of RR of Sec. 33, and the West 14.1/2 acres of that part of West 1/2 of Southeast 1/4 south of RR of Sec. 33, all in Township 42 North, Range 11, East of the 3rd P.M. according to plat recorded May 22, 1917 in Book 152 of Plats Page 15 (except that part lying South of a line 50 ft. north of and parallel to south line of said Sec. 33) in eook County, Illinois. Section 2. That said real estate as reclassified shall be sub)ect to ail the limitations and conditions placed upon properties in the I-l zoning classification, as defined in the ordinances aforernent ioned. Section 3. That any person, firm or corpora tion who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than One Hundred ($100.00) Dollars for each offense, and each day that a violation is permitted to exist shall constitute a separate offense. Section 4. That this ordinance shall be in full force and efrect from and after its passage, approval and publication, Qecording to law.
