I i I i I i ,I Ii I' II II Ii II II II II !I i I ORDINANCE NO. 1057 AN ORDINANCE AMENDING CHAPTER IXB OF THE MOUNT PROSPECT BUILDING CODE I 'I I: BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: Section One: Paragraph 2 of Chapter IXB of the Mount Prospect Building Code defining "Private Residential Swimming Pool" is hereby amended to read as follows: "2. Definition. The term 'Private Residential Swimming Pool' is hereby defined as a receptacle for water, or an artificial pool of water having a depth of more than two (2) feet at any point, intended for the purpose of immer- sion or partial immersion therein of human beings, and including all appurtenant equipment, constructed, installed, and maintained in or above the ground outside of a building used in whole or in part for residential purposes. Provided further that such private residential swimming pool is main- tained primarily for the use of residents within said residential development or for the guests of such residents and not for the purpose of profit or in connection with any business operated for profit. Nothing herein provided shall prevent a charge for the use of said pool, provided said pool is developed in conjunction with a residential develop- ment and is restricted in use to residents of said develop- ment or their guests. No out-of-doors swimming pool for the use of members and their guests of a non-profit club or organization, or limited to house residents of a multiple- dwelling unit, a block, subdivision, neighborhood, community or other specified area of residence, shall be permitted in a single-family residence or duplex residence district." Section Two: Paragrph 3 of Chapter IXB of the Mount Prospect Building Code is hereby amended by deleting therefrom the foll~wing: "(a) Private residential swimming pools shall be permitted in R-I Residential Zones only. (b)" Section Three: This ordinance shall be in full force and effect from and after its passage, approval and publication in the manner provided by law.
