HomeMy WebLinkAboutOrd 1067 07/20/1965 Case No. 65-6 Applicants: Jacob and Helen Kellen Location of Property: NE corner of Golf Road and William Street Ordinance No. fbb~ AN ORDINANCE VARYING THE USE REGULATIONS FOR PROPERTY AT THE NORTHEAST CORNER OF GOLF ROAD AND WILLIAM STREET TO PERMIT THE CONTINUATION OF A GARDEN SUPPLY BUSINESS WHEREAS, The o~mers of the property hereinafter described, Jacob Kellen and Helen Kellen, were, on the date the said property was annexed to the Village of Mount Prospect, con- ducting a wholesale and retail greenhouse business and a garden supply business on the said property, and ~ffiEREAS, Upon annexation to the Village of Mount Prospect the said property was classified in the R-l Single- Family Residence District, and WHEREAS, Upon said classification in the R-l Single- Family Residence District the existing wholesale and retail greenhouse business and the garden supply business of the aforesaid Jacob Kellen and Helen Kellen became legal nonconform- ing uses, and WHEREAS, Said Jacob Kellen and Helen Kellen have applied for a variation to allow them to continue their uses as aforesaid and to permit the construction of a new building for their said garden supply business, and WHEREAS, The said Jacob Kellen and Helen Kellen have tendered to the Village of Mount Prospect a letter dated July ~, 1965, agreeing that if the above-described variation is granted they will not thereafter use the said variation, or the existence of the wholesale and retail greenhouse business or garden supply business, as evidence in a petition for rezon- ing or a lawsuit that the classification of the property -2- Fe. <Ye IINy i3USi"'~5S C.~ COMME~C'~L. C"M~ D~tp~t would be reasonable and appropriate, and WHEREAS, Said Jacob Kellen and Helen Kellen have agreed to abide by the conditions hereinafter set forth in this ordinance, NO~l, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: SECTION ONE: The use regulations imposed by the Zoning Ordinance of the Village of Mount Prospect are hereby varied to permit the use of the following described premises for a wholesale and retail greenhouse business and a garden supply business and to permit the construction of a building on said property to be used in connection with such businesses: Parcel A That part of the West 325.71 feet (measured at right angles to the West line thereof) of Lot 7 in O~mers Subdivision of Section 13, Township 41 North, Range 11, East of the Third Principal Meridian, lying South of a line drawn at right angles to the West line of Lot 7 from a point on said West line which is 1004.70 feet South of the Northwest corner of said Lot 7 (except the West 100 feet thereof); all in Cook County, Illinois. Parcel B That part of Lot 7 in Owners Subdivision of Section 13, Township 41 North, Range 11, 3ast of the Third Principal Meridian, described as follows: Commencing at the intersection of the East line of the West 325.71 feet, measured at right angles to the West line thereof, of said Lot 7, with the Southerly line of said Lot 7; thence North on the Last line of the West 325.71 feet aforesaid, 344 feet to the place of beginning; thence East at right angles to the last described line 25 feet; thence North parallel with the West line of said Lot 7, 179.94 feet more or less to a line drawn at right angles to the West line of said Lot 7, from a point on said West line, which is 939.70 feet South of the Northwest corner of said Lot 7; thence West along last described right angle line, 25 -3- feet to the East line of the West 325.71 feet aforesaid, thence South along the East line of the West 325.71 feet aforesaid 179.94 feet more or less, to the place of beginning, all in Cook County, Illinois. SECTION TWO: The variation granted by this ordinance shall be null and void and of no force and effect whatsoever unless there is compliance with the following conditions: 1. The proposed building shall be completed within one year from the date that this ordinance is passed and approved. 2. The proposed building shall be set back at least 100 feet from the right-of-way line of Golf Road. 3. At least 25% of the area of the tract upon which the said garden supply business is conducted shall be assigned and reserved for space designed to be used for off-street parking facilities. 4. The proposed building shall otherwise comply with all of the applicable area, setback, and bulk regulations provided for the R-l Single- Family Residence District under and by virtue of the Zoning Ordinance of the Village of Mount Prospect. 5. No use shall be made of the above-described prop- erty for any use except the conduct of a whole- sale and retail greenhouse business and a garden supply business or a use otherwise permitted in the R-l Single-Family Residence District pursu- ant to the Zoning Ordinance of the Village of Mount Prospect. SECTION THREE: This ordinance shall be in full force and effect from and after its passage, approval and publication -4- in the manner provided by law. AYES: ~.
