CAF/ 3/24194 ORDINANCE NO. 4633 AN ORDINANCE GRANTING A CONDITIONAL USE IN THE NATURE OF PLANNED UNIT DEVELOPMENT FOR PROPERTY GENERALLY KNOWN AS CLOCKTOWER PLACE WHEREAS, Mount Prospect CIocktower Place Joint Venture (hereinafter referred to as Petitioner) has filed a petition for a Conditional Use in the nature of a Planned Unit Development with respect to property located in the general vicinity between Northwest Highway and Central Road and between Wille and Pine Streets, and generally known as Clocktower Place (hereinafter referred to as the Subject Property); and WHEREAS, the Subject Property is legally described as follows: Lots 1, 2 and 3 in Clock Tower Place Subdivision in the West Half of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, Cook County, Illinois and WHEREAS, Petitioner desires to create a Planned Unit Development containing three buildings with 139 residential condominium units and approximately 7,500 square feet of retail space, as shown on the Site Plan attached hereto; and WHEREAS, a public hearing was held on the request for the Conditional Use, designated as ZBA Case No. 6-CU-94, before the Zoning Board of Appeals of the Village of Mount Prospect on the 7th day of March, 1994, pursuant to proper legal notice having been published in the Mount Prospect Herald on the 18th day of February, 1994; and WHEREAS, the Zoning Board of Appeals has submitted its findings on the proposed Conditional Use to the President and Board of Trustees; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have determined that the best interests of the Village of Mount Prospect will be attained by granting to the Subject Property the Conditional Use in the nature of a Planned Unit Development as requested in ZBA 6-CU-94. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That a Conditional Use in the nature of a Planned Unit Development is hereby granted to allow the Subject Property to be developed with 3 buildings containing 139 residential condominium dwelling units and 2 buildings containing a total of approximately 7,500 square feet of retail space, as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: That the Planned Unit Development granted herein is subject to the BA 6-CU-94 Page 2 of 2 following: 1. To permit eight foot 6 inch (8' 6") wide parking stalls in lieu of the minimum 9' requirement. 2. To allow a forty foot (40') setback along the Central Road frontage in lieu of the required 51'. 3. Petitioner shall submit signage details to the Plan staff for review and approval prior to installation. 4. Petitioner shall submit specification plans for the proposed gazebo and ancillary landscape features. In addition, Petitioner shall install a minimum of six inch (6") to eight inch (8") caliper tress as stated in the Petitioner's proposal. 5. Petitioner shall install brick pavers along the Wille Street and Pine Street frontages consistent with the improvements throughout the Central Business District. It is recommended that the Petitioner install the brick paver system along the private walks on the Subject Property. 6. Petitioner must submit cross access easement documentation for the commercial loading area for review by staff. 7. Petitioner shall make all roadway modifications along the adjacent frontages as determined necessary by the Village. 8. Petitioner shall comply with all Village Codes, policies and regulations. SECTION THREE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
