CAF $~4~4 ORDINANCE NO. 4635 AN ORDINANCE GRANTING MODIFICATIONS FROM THE DEVELOPMENT CODE (CHAPTER 16) OF THE VILLAGE CODE OF MOUNT PROSPECT RELATIVE TO PROPERTY COMMONLY KNOWN AS CLOCK TOWER PLACE WHEREAS, Mount Prospect Clock Tower Joint Venture (hereinafter referred to as Petitioner) has requested modifications from the Development Code (Chapter 16) for property commonly known as Clock Tower Place (hereinafter referred to as Subject Property), legally described as follows: Lots 1, 2 and 3 in Clock Tower Place Subdivision in the West Half of Section 12, Township 41 North, Range 11, East of the Third Principal Meridian, in Cook County, Illinois and WHEREAS, Petitioner has requested the following modifications from the Development Code: 1. To allow a right-of-way width of forty feet (40') on the south half of Central Road, rather than the required 50. 2. To allow a right-of-way width of thirty-three feet (33') on the north half of Northwest Highway, rather than the required 50. WHEREAS, the Plan Commission did consider the modifications from the Development Code, as set forth hereinabove, at their regular meeting held on March 9th, 1994; and WHEREAS, the Plan Commission has forwarded its recommendation to the President and Board of Trustees of the Village of Mount Prospect, and the President and Board of Trustees have determined that the best interests of the Village would be served in granting the modifications requested herein. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the recitals set forth hereinabove are incorporate herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: That modifications from the Development Code (Chapter 16) are hereby granted to the Subject Property as follows: 1. To allow a right-of-way width of forty feet (40') on the south half of Central Road, rather than the required 50'. 2. To allow a right-of-way width of thirty-three feet (33') on the north half of Northwest Highway, rather than the required 50. .~.ECTION THREE: Except for the modifications granted herein, all other requirements odifications Clock Tower Place Page 2 of 2 of said Development Code shall apply to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
