CW/caf 4/14/94 ORDINANCE NO. 4638 AN ORDINANCE TO AMEND ARTICLE IV ENTITLED "WATER AND WATER SUPPLY" AND ARTICLE V ENTITLED "METERS AND RATES" OF CHAPTER 22 OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Section 22.401 entitled "Turning On; Application Fee" of Article IV entitled "Water and Water Supply" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.401 shall be and read as follows: " Sec. 22.401. Tuming On; Application, Fee. No water from the Village water supply shall be turned on for service into any premises by any person but the Director of Public Works or some person authorized by him/her to perform this service. Application to have water turned on shall be made in writing to the Director of Public Works and shall contain an agreement by the applicant to abide by and accept all of the provisions of this Chapter as conditions governing the use of the Village water and sewer system by the applicant." SECTION TWO: That Section 22.501 entitled "Meters Required" of Article V entitled "Meters and Rates" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.501 shall be and read as follows: " Sec. 22.501. Meters Required. Before any premises are occupied, a Village-owned water meter shall be installed therein or application made for each installation, as hereinafter specified, and no water shall be furnished such premises in the absence of said installation or application. All premises using the Village water supply must be equipped with an adequate Village-owned water meter to be furnished, installed and maintained by the Village at the cost and expense of the consumer;, provided, however, that water may be supplied by the Village at a fiat rate of charge between the time of the aforesaid application and the date when such meter is connected. Meters shall be installed in a location that will be easy to access." SECTION THREE: That Section 22.502 entitled "Meters Required" of Article V entitled "Meters and Rates" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.502 shall be and read as follows: " Sec. 22.502. Reading Meters. A. The Director of Public Works shall read or cause to be reading every water meter used in the Village at such times as are necessary that bills may be sent out at the proper time. B. In the event that a water meter reading is not obtained at least five (5) days pdor to the mailing date of a water bill, the Director of Finance shall establish an estimated meter reading to be used for billing purposes based upon a like Chapter 22 Page 2 of 4 period during the preceding year or in such manner as the Director may determine, in the event that a meter reading is estimated for three (3) consecutive billing periods, the Director of Finance shall notify the consumer and/or property owner that a meter reading is required. After such notice and the failure of the consumer and/or property owner to provide access to the water meter within ten (10) days after such notice, the Public Works Director may discontinue water service at such location. Water service will be turned on upon receipt of the meter reading and payment of fifty dollars ($50.00) for expenses incurred in shutting off and turning on the water; C. W~ere a water meter is so located that it is not readily accessible to reading by Village officials or in the event any given user's water meter cannot be read, the Director of Public Works or his/her authorized representative is hereby authorized to request in writing that the property owner, at the property owner's expense, remove any obstruction within a time limit set by the Director of Public Works or his/her authorized representative. D. The reading of the inside meter is the meter of record and prevails over all other readings." SECTION FOUR: That paragraphs A and B of Section 22.503 entitled "Testing Meters" of Article V entitled "Meters and Rates" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.503 shall be and read as follows: " Testing Meters. A. VVhere the accuracy or record of a water meter is questioned, it shall be removed at the consumer's or owner's request and, if so desired, shall be tested in his/her presence in the shops of the Water Department by means of the apparatus there provided and a report thereof duly made. Both parties to the test must accept the findings so made. If the test discloses an error against the consumer of more than three percent (3%) in the meter's registry, the excess of the consumption on the bill shall be adjusted and the entire expense of the test will be borne by the Village, and the deposit required as hereinafter prescribed shall be returned. Where no such error is found, the person who has requested the test shall pay the actual expense of the test whether performed by an independent testing service or the Village of Mount Prospect. B. Before making a test of any meter, the person requesting such test shall at the time of making application for a test make a deposit of fifty dollars ($50.00) at the office of the Finance Department subject to the conditions of this Section." SECTION FIVE: That paragraphs A and B of Section 22.504.2 entitled "Water Rates" of Article V entitled "Meters and Rates" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.504.2.A and Section 22.504.2.B shall be and read as follows: " Sec. 22.504.2. Water Rates. A. All Village users within the Village, having a direct or indirect connection with Village water mains or pipes shall pay the following rate: Water Rate For each 1,000 gallons of water consumed or portion thereof $2.70 Chapter 22 Page 3 of 4 B. All Village users outside the corporate limits of the Village having a direct or indirect connection with Village water mains or pipes shall pay the following rate: Water Rate For each 1,000 gallons of water consumed or portion thereof $5.40" SECTION SIX: That paragraph C of Section 22.504.3 entitled "Sewer Rates" of Article V entitled "Meters and Rates" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.504.3.C shall be and read as follows: " C. Rate: 1. All Village sewer users within the corporate limits of the Village having a direct or indirect connection with the Village sewer and water mains or pipes shall pay the following sewer rate, based upon the amount of water consumed to which sewer service is furnished: Per 1,000 gallons of water consumed or portion thereof $0.28 2. All Village sewer users within the corporate limits of the Village having a direct or indirect connection with the Village sewer mains or pipes and not with the Village water mains or pipes shall pay a fiat rate of: Per month per dwelling unit $2.50 3. All sewer users outside the corporate limits of the Village having a direct or indirect connection with the Village sewer and water mains or pipes, shall pay the following sewer rate based upon the amount of water consumed to which sewer service is furnished: Per 1,000 gallons of water consumed or portion thereof $0.28 4. All sewer users outside the corporate limits of the Village having a direct or indirect connection with the Village sewer mains or pipes, but not with Village water mains or pipes, shall pay a fiat rate of: Per month per dwelling unit $2.50 " SECTION SEVEN: That Section 22.505 entitled "Billing" of Chapter 22 of the Village Code, as amended, is hereby further amended in its entirety; so that hereinafter said Section 22.505 shall be and read as follows: " Sec. 22.505. Billing. Billings for the above charges shall be compiled and processed bi-monthly, or as the Director of Finance shall determine. Users of both water and sewer shall receive a combined bill. For users within the corporate limits of the Village, the Village may mail water and sewer bills to users other than the property owner as directed by the property owner, notwithstanding any agreement between a property owner and the tenant regarding the payment of water and sewer bills shall not be binding to the Village. For users outside the corporate limits of the Village, the billing for water and sewer shall be billed to and be the responsibility of the legal or beneficial owner of the property." 3 hapter 22 Page 4 of 4 SECTION EIGHT: The water rate established in SECTION FIVE and the sewer rates established in SECTION SIX of this Ordinance shall be effective for water used subsequent to April 30, 1994. SECTION NINE: This Ordinance shall be in full force and effect following its passage, approval, and publication in pamphlet form in accordance with law.
