ORDINANCE NO. 1096
AN ORDINANCE TO AMEND CHAPTER IX B OF THE MOUNT
PROSPECT BUILDING CODE RELATING TO SWIMMING POOLS
BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT:
SECTION OWE: Chapter IX B of the Mount Prospect
Building Code is hereby amended by adding after Section 22
thereof four new Sections numbered 23.24.25. and 26. the said
Sections 23. 24. 25. and 26 to be and read as follows:
23. Project Above Ground Level. No private
residential swimming pool that exceeds
two (2) feet in depth shall be constructed
or established so that it will project
more than six (6) inches above the ground
level of the lot or premises on which it
is located.
24. Portable or Prefabricated Pools. All
portable or prefabricated private residential
swimming pools that exceed two (2) feet
in depth shall comply with all of the
requirements of this Chapter IX B.
25. Nonconforming Swimming Pools. All private
residential swimming pools that do not con-
form with the provisions and requirements. of
this Chapter IX B shall be eliminated.
removed or made to conform with the provi-
sions of this Chapter IX B with-in five years
from the effective date of this Section 25.
26. Penalty. Any person who shall violate any
prov~s10n of this Chapter IX B or who shall
erect. construct. alter or repair a private
residential swimming pool in violation
thereof. shall be fined not less than $25
nor more than $100 for each offense. and a
separate offense shall be deemed to have
been committed on each day during which or
on which a violation occurs or continues.
The imposition of the penalties herein
prescribed shall not preclude the Village
from instituting such action or proceedings
as it may deem necessary to prevent or
restrain the unlawful establishment. con-
struction. reconstruction. alteration.
repair. conversion. maintenance. or use of
a private residential swimming pool or to
restrain. correct or abate any violation
of this Chapter IX B.
SECTION TWO: This ordinance shall be in full force
and effect from and after its passage. approval and publication
in the manner provided by law.
