HomeMy WebLinkAboutOrd 1103 10/26/1965 ORDINfu~CE NO. 1103 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF MOUNT PROSPECT BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OFMOUNT PROSPECT: SECTION ONE: The Zoning Ordinance of the Village of Mount Prospect, as amended, is hereby further amended by delet- ing therefrom all of Section 33 and substituting in its place a new Section 33, the new Section to be and read as follows: Section 33. Amendments. (A) Jurisdiction of Plan Commission. The Plan Commission of the Village of Mount Prospect is hereby vested with the following jurisdiction and authority: (1) To hold public hearings on requests for amend- ments to this ordinance and to make findings and recommendations, and to forward the same to the President and Board of Trustees; and (2) To initiate, direct and review from time to time a study of the provisions of this ordinance II and to make reports on its findings and recom- il I mendations thereon to the President and Board of Trustees not less frequently than annually. (B) Authorization. The regulations imposed and the districts created under the authority of this ordinance may be amended in the manner provided by Section 11-1314 of the Illinois Municipal Code. No such amendment shall be adopted by the President and Board of Trustees unless a public hearing on the proposed amen- i I I I Ii II I' II I' ment has first been held by the Plan Commission of the Village of Mount Prospect. , , (C) Initiation of Amendments. Amendments may be proposed by the President and Board of Trustees, by the Plan Commission, by any owner or person who has an interest in any property proposed to be rezoned, or by any other resident of the Village of Mount Prospect. (D) Application for Amendment. Proposed amendments initiated by the President and Board of Trustees or by any officer, department, board or bureau of the Village of Mount Prospect shall be referred directly to the Plan Commission. An application made by any other person for an amendment to any of the provisions of this ordinance, or to any of the districts created thereby shall be it Ii I, II Ii filed with the Village Manager. Such fee shall be sufficient to defray the cost of publication of notice, the preparation of a transcript of the public hearing on the pro- posed amendment, and thecost of a special meeting of the Plan Commission when the applicant has requested such special meeting. (E) Processing of Application. Upon receipt of an application for an amendment to the Zoning Ordinance, the Village Manager shall transmit the application to the Plan Commission prior to its next scheduled meeting. A copy of the application for an amendment shall be transmitted to the President and Board of Trustees. (F) Public Hearing. The Plan Commission shall hold a public hearing on all proposed amendments. The time and place of such public hearing shall be set by the Plan Commission. The public hearing shall -2- i I I I I I I I I, II II I i referred to it. If such committee does not make its said report within such 4 month period, than the President shall discharge the said committee from further responsibility for consideration of the said findings and recommendations and place the same on the agenda for the next regular meeting of the Board of Trustees. (I) Protest. In case a written protest against any propssed amend- ment of the regulations or districts created by thisorudinance is filed with the Clerk of the Village of Mount Prospect, which protest is signed and acknowledged by the owners of 20% of the frontage proposed to be altered, or by the owners of 20% of the frontage immediately adjoining or across an alley therefrom, . or by the owners of 20% of the frontage directly opposite the frontage proposed to be altered, then such proposed amendment shall not be passed except by a favorable yote of two-thirds of I: ii II Ii II I, 'I !I I!
