CAF 12/14~94 ORDINANCE NO. 4696 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS LIONS PARK SCHOOL, LOCATED AT 300 EAST COUNCIL TRAIL WHEREAS, the Dr. Thomas W. Many, on behalf of Mount Prospect Schools, District 57, (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as Lions Park School, located at 300 East Council Trail Street (hereinafter referred to as Subject Property), legally described as: Lot 1 in Lions Park School Plat of Consolidation, being a consolidation of parts of the Southwest Quarter of Section 12,Township 41 North, Range 11, East of the Third Principal Meridian, all in Cook County, Illinois; and WHEREAS, Petitioner seeks a variation from Section 14.905.B.2 to permit parking in the front yard setback; and WHEREAS, a public hearing was held on the variation requested being the subject of ZBA Case No. 48-V-94 before the Zoning Board of Appeals of the Village of Mount Prospect on the 27th day of October, 1994, pursuant to due and proper notice thereof published in the Mount Prospect Journal on the 12th day of October, 1994; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 48-V-94 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.905.B.2 to allow parking in the front yard setback of the Subject Property, as shown as the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: This Ordinance shall be in full force and effect from and after its BA 48-V-94 Page 2 of 2 passage, approval and publication in pamphlet form in the manner provided by law.
