I I ORDINANCE NO. 1111 AN ORDINANCE AMENDING THE SIGN ORDINANCE TO REQUIRE BONDS FOR PROJECTING SIGNS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT: SECTION ONE: Article III of Chapter 9 of the Munici- pal Code of Mount Prospect of 1957. as amended. is hereby further amended by deleting therefrom all of Section 9.306 thereof and inserting in its place a new Section 9.306. the said new Section to be and read as follows: Section 9.306. Bond Requirements. (A) Sign C~mtractors. A .person engaged in the business of constructing and erecting billboards or signs shall file with the Super- intendent of Building a bond in the penal su~ of Twenty-five Thousand Dollars with a responsible surety company as surety thereon. Such bond shall be approved as to form by the Village Attorney and shall indemnify the Village of Mount Prospect and its officials and employees and hold it and them harmless for the full period of time provided for by the Statutes of Limitations of the State of Illinois. for any and all loss, cost. expense or liability of any kind or nature whatsoever. which said Village or its officials or employees may suffer or be put to. or which may be recovered from it or them by reason of the issuance of such permit and/or the construction or erection of any bill- board or sign. (B) Projecting Signs. Ne projecting sign shall be hereafter maintained. and no permit shall be issued for any new projecting sign. unless the owner or occupant of the premises to which such projecting sign is or will be attached shall have filed with the Superintendent of Building either an indemnity bond or a certificate of insurance as provided in this paragraph (B). Such indemnity bond or certificate of insurance shall be approved as to form by the Village Attor- ney. shall be for a term of one year. and shall be renewed annually for so long as such projecting sign remains in place. No such annual renewal of any such indemnity bond or certificate of insurance shall be accepted by the Superintendent of Build- ing unless the owner or occupant of the premises to which the sign is affixed has permitted the Superintendent of Building. or his duly authorized deputy. to inspect the said sign and said inspec- tion has desclosed that the said sign is safe. secure and has been maintained in comformity with the provisions of this Article III of Chapter 9 and with the provisions of all other applicable ordinances of the Village. (1) An indemnity bond provided pursuant to this Section 9.306(B) shall be in the penal sum of Twenty-five Thousand Dollars and shall have a responsible surety company as surety thereon. Such bond shall indemnify the Village of Mount Prospect and its officials and employees. and hold it and them harmless. for the full period of time provided for by the Statute of Limita- tions of the State of Illinois. for any and all loss. cost. expense. or liability of any kind or nature whatsoever. which said Village or its officials or employees may suffer or be put to. or which may be recovered from it or them by reason of the maintenance of a project- ing sign. (2) A certificate of insurance provided pursuant to this Section 9.306 (B) shall evidence that the owner or occupant of the premises on which a projecting sign is located has and will have in full force and effect. for a term of at least one year sub- sequent ot the date of such certifi- cate. a policy of public liability insurance with respect to such premises and any projecting sign or signs thereon. Such policy of public liability insurance shall provide the following coverage: (a) With respect to personal injuries. $1000.000 per person. and $3000.000 per accident or occurence; and (b) With respect to property Gamage. $25.000 per person and $50.000 per accident or occurrence. Such policy of insurance shall be written by a responsible insurance company. shall name the Village of Mount Prospect and its officials and employees as additional insureds thereunder. and shall insure the owner or occupant and the said Village and its said officials and employees against any and all loss, cost. expense or lia- bility of any kind or nature whatsoever arising out of or incidental to the maintenance of such sign and any repair or other work theron. whether such loss. cost. expense or liability is occasioned by the negligent acts of said owner or occupant. or said Village or its officials or employees, or otherwise.
