CAF/ 12/14/94 ORDINANCE NO. 4694 AN ORDINANCE VACATING CERTAIN RIGHT-OF-WAY OWNED BY THE VILLAGE OF MOUNT PROSPECT (207 MOEHLING DRIVE) WHEREAS, the corporate authorities of the Village of Mount Prospect did consider the vacation of certain Village owned right-of-way, namely the unimproved as well as improved right-of-way located immediately north of 207 East Moehling Drive, Mount Prospect, which right-of-way is no longer useful or necessary to the Village; and WHEREAS, the right-of-way being the subject of this Ordinance is legally described as follows: That part of Moehling Drive beginning at the Northeast'COrner of Lot 2 in Ellendale Subdivision, thence North 89 degrees 54 minutes 38 seconds West 65.13 feet along the North line of said Lot 2, thence North 00 degrees 03 minutes 46 seconds East 50.50 feet along the West line of Lot 2 extended, thence South 89 degrees 54 minutes 38 seconds 65.13 feet along the South line of the North 60 rods of the Southwest Quarter of Section 12, thence south 00 degrees 03 minutes 46 seconds West 50.50 feet to the point of beginning, all in Cook County, Illinois; and WHEREAS, a Public Hearing was held by the corporate authorities of the Village of Mount Prospect on December 6, 1994, at which time the corporate authorities did determine that it would be in the best interests of the Village to vacate the unimproved public walkway being the subject of this Ordinance; and NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the corporate authorities of the Village of Mount Prospect did hold a Public Hearing to consider vacating certain right-of-way, as shown on the Plat of Vacation attached hereto and hereby made a part hereof as Exhibit "A". SECTION TWO: That the corporate authorities of the Village of Mount Prospect have determined that the best interests of the Village would be served by vacating said right-of-way, provided, however, that any and all utility easements shall remain to benefit the Village. SECTION THREE That upon the passage and approval of this Ordinance by a 2/3 vote of the corporate authorities, the Village Clerk is hereby authorized and directed to file a certified copy of this Ordinance, together with an accurate map of the vacated area, with the Cook County Recorder of Deeds. SECTION FOUR: That this Ordinance shall be in full force and effect from and after acate Page 2 of 2 its passage, approval and publication in pamphlet form in the manner provided by law.
