ORDINANCE NO. 4684
AN ORDINANCE GRANTING A CONDITIONAL USE FOR PROPERTY
COMMONLY KNOWN AS 1738 EAST KENSINGTON ROAD
WHEREAS, D. D. & D. Enterprises (hereinafter referred to as Petitioner) has filed a
petition for a Conditional Use for property generally located at 1738 East Kensington
Road (hereinafter referred to as the Subject Property); and
WHEREAS, the Subject Property is legally described as follows:
Lots 1 and 2 in Brentwood Square being a subdivision of part of the West 1/2
of the Southwest 1/4 in Section 25, Township 42 North, Range 11, East of
the Third Principal Meridian, in Cook County, Illinois recorded October 6,
1988 as Document # 88-460938; and
WHEREAS, Petitioner seeks a Conditional Use in order to permit a Day Care Center and
play-yard in the Brentwood Square Shopping Center; and
WHEREAS, a public hearing was held on the request for Conditional Use, designated as
ZBA Case No. 45-0U-94, before the Zoning Board of Appeals of the Village of Mount
Prospect on the 27th day of October, 1994, pursuant to proper legal notice having been
published in the Mount Prospect Journal on the 12th day of October, 1994; and
WHEREAS, the Zoning Board of Appeals has submitted its findings and
recommendations to the President and Board of Trustees in support of the request being
the subject of ZBA 45-0U-94; and
WHEREAS, the President and Board of Trustees of the Village of Mount Prospect have
given consideration to the request herein and have determined that the same meets the
standards of the Village and that granting said Conditional Use would be in the best
interests of the Village.
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS:
SECTION ONE: The recitals set forth hereinabove are incorporated as findings of fact
by the President and Board of Trustees of the Village of Mount Prospect.
SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect
do hereby grant a Conditional Use to the Subject Property to operate of a Day Care
Center with play area subject to the condition that a current copy of the license issued
by the State of Illinois in order to operate a Day Care Center is on file with the Director
of Planning of the Village of Mount Prospect.
SECTION THREE: That all other rules and regulations of the Village of Mount Prospect

shall apply.
SECTION FOUR: This Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form in the manner provided by law.
