CAF/ 10/13~94 ORDINANCE NO. 4679 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 4 JERRY DRIVE WHEREAS, Richard L. and Colleen P. Anda (hereinafter referred to as Petitioners) have filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 4 Jerry Ddve (hereinafter referred to as Subject Property), legally described as: Lot Two Hundred Ninety Six (296) in Third Addition to Bluett's Fairview Gardens, being a subdivision of part of the East Half of the Southeast Quarter of Section 35, Township 42 North, Range 11, East of the Third Principal Meridian, according to plat thereof registered in the Office of the Registrar of Titles of Cook County, Illinois, on January 19, 1962 as Document No. 2016922 and Certificate of Correction thereof registered on March 14, 1962 as Document No. 2023843; and WHEREAS, Petitioners seeks a variation from Section 14.306. B. 1 to allow a existing 156 square foot storage shed, rather than the maximum 120 square feet permitted; WHEREAS, a public hearing was held on the variation requested, being the subject of ZBA Case No. 41-V-94, before the Zoning Board of Appeals of the Village of Mount Prospect on the 22nd day of September, 1994 pursuant to due and proper notice thereof published in the Mount Prospect Journal on the 7th of September, 1994; and WHEREAS, the Zoning Board of Appeals has submitted its findings and recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees of the Village have given further consideration to the variation being the subject of ZBA 41-V-94 and have determined that the best interests of the Village of Mount Prospect would be served by granting said variation. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant to the Subject Property a variation from Section 14.306.B.1 to permit an existing storage shed 156 square feet in size, as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit "A". SECTION THREE: Except for the variation granted herein, all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. SECTION FOUR: In accordance with the provisions of Section 14.203.12 of Chapter 14 of the Village Code, the variation granted herein shall be null and void unless permits are BA 41-V-94 Page 2 of 2 issued and construction begins within one (1) year from the date of passage of this Ordinance. SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
