IX. CONSENT AGENDA * All items listed with an asterisk are considered routine by the Village Board and will be enacted by one motion. There will be no separate discussion of those items unless a Board member, or resident from the audience so requests, in which event the item will be removed from the Consent Agenda and considered in its normal sequence on the agenda. X. OLD BUSINESS A. PZ-14-06, 1040 W. Northwest Highway, Mount Prospect Development Group 1. 2nd reading of AN ORDINANCE AMENDING THE OFFICIAL ZONING MAP OF THE VILLAGE OF MOUNT PROSPECT FOR PROPERTY LOCATED AT 1040 W. NORTHWEST HIGHWAY This ordinance rezones the subject property from B1 Business Office to R2 Attached Single Family Residence to allow a 17 unit townhome development. The Planning and Zoning Commission has recommended by a vote of 5-2 to deny the request; adoption of the ordinance requires a super majority vote for approval. 2. 2nd reading of AN ORDINANCE GRANTING A CONDITIONAL USE PERMIT AND VARIATION FOR PROPERTY LOCATED AT 1040 W. NORTHWEST HIGHWAY This ordinance grants a Conditional Use Permit for a Planned Unit Development, and a Variation for lot coverage to allow the construction of a 17 unit townhome development. The Planning and Zoning Commission has recommended by a vote of 5-2 to deny the request; adoption of the ordinance requires a super majority vote for approval. (By a vote of 5-0 the Village Board approved deferral of the second reading until the June 19, 2007 Village Board meeting.) B. PZ-09-07, 501 Midway Drive, Niagara Foundation 2nd reading of AN ORDINANCE GRANTING A CONDITIONAL USE FOR NIAGARA EDUCATIONAL SERVICES, INC., 501 MIDWAY DRIVE This ordinance grants a Conditional Use permit to operate a Community Center and school at 501 Midway Drive, Niagara Foundation. The Planning and Zoning Commission recommended approval by a vote of 7-0. (Exhibit A) (Exhibit B) (Exhibit C) XI. NEW BUSINESS A. PZ-07-07, 601 East Kensington Road (Exhibit D) 1st reading of AN ORDINANCE GRANTING A CONDITIONAL USE IN THE NATURE OF A MIXED USE PLANNED UNIT DEVELOPMENT FOR PROPERTY LOCATED AT 601 EAST KENSINGTON ROAD This ordinance grants a Conditional Use permit to construct a mixed use Industrial/commercial planned unit development. The Planning and Zoning Commission recommended approval of the Conditional Use permit by a vote of 7-0. B. 1st reading of AN ORDINANCE AMENDING CHAPTER 7 (SIGN REGULATIONS), (Exhibit E) CHAPTER 19 (HEALTH REGULATIONS), CHAPTER 21 (BUILDING CODE), CHAPTER 23 (OFFENSES AND MISCELLANEOUS REGULATIONS) AND APPENDIX A OF THE VILLAGE CODE. This ordinance makes minor updates to the Village Code related to Environmental Health regulations. C. * A RESOLUTION AUTHORIZING THE EXECUTION OF AN (Exhibit F) INTERGOVERNMENTAL AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND THE VILLAGE OF ELK GROVE VILLAGE REGARDING THE USE OF THE VILLAGE OF MOUNT PROSPECT JAIL This resolution authorizes the Village of Elk Grove Village to use the Village of Mount Prospect jail facilities during the construction of the Elk Village's new administrative and public safety complex. D. * A RESOLUTION AUTHORIZING THE VILLAGE OF MOUNT PROSPECT TO (Exhibit G) ESTABLISH AN ICMA RETIREMENT GOVERNMENTAL PURCHASE PLAN & TRUST This resolution authorizes establishment of a money purchase retirement plan, administered by ICMA. E. * A RESOLUTION REQUESTING CLOSURE OF A PORTION OF CENTRAL (Exhibit H) ROAD IN ORDER TO CONDUCT A PARADE F. * A RESOLUTION AUTHORIZING THE EXECUTION OF A LEASE AGREEMENT (Exhibit I) BETWEEN THE VILLAGE OF MOUNT PROSPECT AND CAPANNARI, INC. (CAPANNARI ICE CREAM) This resolution authorizes the Village to enter into a contract with Capannari, Inc. (Capannari Ice Cream) for the operation of an ice cream parlor in the former Downtown General Store, located at 10 South Pine Street. G. * A RESOLUTION AUTHORIZING THE EXECUTION OF A PARKING LOT (Exhibit J) ENFORCEMENT AGREEMENT BETWEEN THE VILLAGE OF MOUNT PROSPECT AND NORWOOD BUILDERS (THE EMERSON AND LOFTS & SHOPS AT VILLAGE CENTRE DEVELOPMENTS "CENTER") This resolution authorizes the Village to enter into an agreement with Norwood Builders for the enforcement of parking regulations on the parking area of the "CENTER" by Village of Mount Prospect law enforcement personnel. XII. VILLAGE MANAGER'S REPORT A. * Request Village Board approval to waive bid and grant a construction contract extension for Neighborhood Traffic Sign Project - Zone 12, in an amount not to exceed $29,297. B. * Request Village Board approval to accept NWMC bid for 2007 Crack Sealing Program in an amount not to exceed $56,650. C. *Request Village Board approval to accept NWMC/SPC suburban purchasing cooperative fuel bid. D. *Request Village Board approval to accept State of Illinois bid for the purchase of one truck cab and chassis in an amount not to exceed $58,740. E. * Request Village Board approval to accept proposal for water quality sample testing contract in an not to exceed $15,000. F. Status XIII. OTHER BUSINESS XIV.
