CAF/ 6~26~95 ORDINANCE NO. 4735 AN ORDINANCE GRANTING A VARIATION FOR PROPERTY COMMONLY KNOWN AS 114 NORTH MAIN STREET WHEREAS, Phillip Daus (hereinafter referred to as Petitioner) has filed an application for a variation from Chapter 14 of the Village Code of Mount Prospect, Illinois, for property commonly known as 114 North Main Street (hereinafter referred to as Subject Property), legally described as: Lot 4 in Block 9 in Hillcrest, being a subdivision of the Northeast quarter of the Southwest Quarter (except the North 2-7/8 acres thereof) of Section 34, township 42 North, Range 11, East of the Third Principal Meridian, and the North 23.5 acres of the Southeast Quarter of the Southwest Quarter (except the West 295.1 feet of the South 295.1 feet lying North of the South 543 feet of the East Half of the Southwest Quarter of said Section 34) in Cook County, Illinois WHEREAS, Petitioner has submitted a request for a variation from Section 14.2215.A.3 to allow a 10' x 13' driveway turn-around in the rear of the home, which turn-around is adjacent to the existing 20 feet wide driveway; and WHEREAS, a public hearing was held on the variation requested, being the subject of ZBA Case No. 4-V-95 before the Zoning Board of Appeals of the Village of Mount Prospect on the 8th day of June, 1995, pursuant to due and proper notice thereof published in the Journal Topics on the 19th day of May, 1995; and WHEREAS, the Zoning Board of Appeals did consider the request stated herein and have forwarded their recommendation to the President and Board of Trustees of the Village of Mount Prospect and the President and Board of Trustees have given further consideration to the variation requested and have determined that the best interests of the Village would be served by granting the variation requested. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: The recitals set forth hereinabove are incorporated herein as findings of fact by the President and Board of Trustees of the Village of Mount Prospect. SECTION TWO: The President and Board of Trustees of the Village of Mount Prospect hereby grant a variation from Section 14.2215.A.3 to allow a 10' x 13' turn-around adjacent to the existing driveway, rather than the maximum driveway width of 21', as shown on the Site Plan attached hereto and hereby made a part hereof as Exhibit A. SECTION THREE: Except for the variation granted herein all other applicable Village of Mount Prospect Ordinances and regulations shall remain in full force and effect as to the Subject Property. BA 4-V-95 Page 2 of 2 SECTION FOUR: In accordance with the provisions of Section 14,203.C.12 of Chapter 14 of the Village Code, the variations granted herein shall be null and void unless permits are issued and construction begins within one (1) year from the date of passage of this Ordinance, SECTION FIVE: This Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form in the manner provided by law.
