AN ORDINANCE AMENDING CHAPTER 8
ENTITLED "VILLAGE GOVERNMENT; MISCELLANEOUS PROVISIONS"
OF THE VILLAGE CODE OF MOUNT PROSPECT, ILLINOIS,
REGARDING ELECTION PROCEDURES
WHEREAS, the Village of Mount Prospect ("Village") is a home rule municipality as
defined by Article VII, § 6 of the Illinois Constitution of 1970; and
WHEREAS, the Village has the authority to adopt ordinances and to promulgate rules and
regulations that pertain to its government and affairs and that protect the public health, safety and
welfare of its citizens; and
WHEREAS, pursuant to Article VII, § 6(f) of the Illinois Constitution of 1970, the Village,
as a home rule municipality, has the authority to provide for its officers and their manner of
selection pursuant to referendum or as otherwise provided by law; and
WHEREAS, on November 3, 2009, pursuant to the authority granted to the Village under
Article VII, § 6(f) of the Illinois Constitution of 1970, the Village Board adopted Ordinance No.
5767, placing a binding referendum question on the ballot at the February 2, 2010 general primary
election, asking the residents of the Village if they wanted to adopt a nonpartisan system for
electing officers to municipal offices in the Village; and
WHEREAS, on February 2, 2010, the voters of the Village approved the referendum
question establishing a nonpartisan system of electing officers to municipal office in the Village;
WHEREAS, on September 7, 2010, in furtherance of the approval of the referendum, the
Village Board adopted Ordinance No. 5815, establishing a nonpartisan system for electing officers
to municipal offices in the Village; and

WHEREAS, it was the intent of the Village Board in placing the nonpartisan system
referendum question on the ballot for the February 2, 2010 general primary election to have the
voters to decide whether candidates for elected office in the Village should be prohibited from
running for office as part of a political. party; and
WHEREAS, the practice of circulating joint nomination papers containing the names of
more than one candidate for elected office creates the irreversible public impression that the
candidates are running together as a political party and the practice of running as a political party
for elected office in the Village was abolished by the voters on February 2, 2010; and
WHEREAS, it was the intent of the referendum question approved on February 2, 2010
creating a nonpartisan system of electing officers in the Village candidates be required to run
independently in all. ways and to prohibit the practice of candidates circulating joint nomination

WHEREAS, it is the intent of this Ordinance to clarify the intent of the February 2, 201 O�
referendum question to prohibit candidates for elected office in the Village from circulating joint
nomination papers, and Ordinance No. 5815, adopted in furtherance thereof;
BE IT ORDAINED by the President and Board of Trustees of the Village of Mount
Prospect, Cook County, Illinois, acting in the exercise of their home rule powers, as follows:
SECTION 1, That Subsection. B of Section 8.504, entitled "Election Procedures," of
Article V. entitled "Other Regulations," of Chapter 8 entitled "Village Government; Miscellaneous
Provisions" of the Mount Prospect Village Code is hereby amended by adding a new Subsection
B4, to read in its entirety as follows:
"Candidates for elected office in the Village are prohibited from filing joint nomination
papers containing the names of more than one candidate, as the filing of joint nomination
papers by candidates for elected office in the Village is not in apparent conformity with the
Village's nonpartisan system for electing officers."

SECTION 2. Effective Date. This Ordinance shall be in full force and effect from and
after its passage and approval and publication as required by law.
