WHEREAS, the Village of Mount Prospect ("Village") is a home rule municipality
pursuant to Section 7 of Article VII of the Constitution of the State of Illinois.
WHEREAS, the Village has the authority to adopt ordinances and to promulg
ggate rules and
reulations that pertain to its overnment and affairs and that protect the public health, safety and
welfare of its citize--t[s
WHEREAS, the Planning and Zoning Commission shall review applications for text
amendments and prepare finding of facts and forward their recommendations to the Village Board
for final decision.
WHEREAS, pursuant to Village Code Section 14.203 D 2, the village board shall have
finIl authority for text amendments.
WHEREAS, pursuant to Village Code Section 14.203 D 5, the Planning and Zoning
Commission already held a Public Hearing on November 14, 2019 and unanimously recommended
approval of the proposed text amendment.
WHEREAS, pursuant to Village Code Section 14.203the Director of Community
Development has already submitted the written recommendations of the Planning and Zoning
Commission to the Village Board.
WHEREAS, on December 1 O 2019, the proposed text amendment was not +.r by the
Villae Board

WHEREAS, pursuant to Village Code Section 14.203 D 9, no application for a text
amendment may be resubmitted within one year from the date of denial, except on the 1y. of
new evidence or proof of change of condition found to be valid by the Director of Community
Development.
WHEREAS, at this time, the Director of Community Development has determined vali
new evidence and chaes in conditions have been found that support•
the text amendme

WHEREAS, the President and Board of Trustees find it is in the best interests of th
Village of Mount Prospect community for the Village Board to conduct the Public Hearin
regarding the proposed text amendment since the Planning and Zoning
g Commission already hel
a public hearinin November 2019 and subsequently issued written recommendations. I
WHEREAS, the President and Board of Trustees find it is in the best interests of the
community of the Village of Mount Prospect to approve the Ordinance as herein amended.
NOW, THERE, FORE,BE IT ORDAINED BY THE PRESIDENT AND THE
BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY,
ILLINOIS ACTING IN THE EXERCISE OF THEIR HOME RULE POWERS, as follows:
SECTION 1: Each of the Whereas paragraphs above are incorporated into Section 1 of
this Ordinance as material to ins hereof.
SECTION 2: The Village President and Board of Trustees of Village of Mount Prospect
hereby waive the Planning and Zoning Commission's conduct of a public hearing pursuant to
Village Code Section 14.203 D 5 for the purposes of this specific text amendment only.
SECTION 3: The Village President and Board of Trustees of Village of Mount Prospect
will conduct the public hearing as required under Village Code Section 14.203 D 5 for the purposes
of this specific text amendment only.
ADOPTED this 10 day of November 2020, pursuant to a roll call vote as follows:
AYES: Grossi, Hatzis, Hoefert, Rogers, Saccotelli, Zadel
NAYS: None
