ORDINANCE NO. 1142
AN ORDINANCE REPEALING SECTION 14.1203 AND At1ENDING
SECTION 14.1202 OF THE MOUNT PROSPECT MUNICIPAL CODE
WHEREAS, the present Section 14.1202 and 14.1203 of the Monnt
Prospect Municipal Code of 1957, as amended, now contains various footage
limitations for location of a service station with reference to certain
type of existing buildings; and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that there should be a uniformity in the
restriction limitations within the provisions of this ordinance.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, ILLI~OIS:
SECTION ONE: Section 14.1203 of the Municipal Code of Mount
Prospect of 1957, as amended, entitled "Further restriction" be and the
same is hereby repealed.
SECTION TWO: Section 14.1202 of the Hunicipal Code of Hount
Prospect of 1957, as amended, be and it is hereby further amended in its
entirety, so that the said Section 14.1202 shall hereafter be and read
as follows:
Section 14.1202 Permit restrictions. No service station or
.tank for the storage of motor fuel as herein defined shall
hereafter .be erected, built, constructed or installed by any
person within the limits of the Village except on a permit duly
issued by the Building Superintendent and countersigned by the
Village Clerk. No permit shall be issued for the erection,
construction, installation or building of any service station
or motor fuel storage tank when the number of and capacity of the
storage tanks exceeds the limitations thereof as prescribed by
the ordinances of this Village or where the property lines of
the property on which such contemplated erection, construction,
installation, or building lies within the following areas:
(a) ~ithin three hundred (300) feet of the property line of
any church, school, hospital, fraternal lodge, hall, theatre,
or place of public assembly;
(b) Within threo hundred (300) feet of the location of any
railway passenger station, freight depot and any buildings
in which not less than 75% of the total floor space is used
for warehouse or storage purposes;
(c) Within three hundred (300) feet of the property line of
any existing service station or tank or gasoline storage tank;
SECTION THREE: All ordinances, or parts of ordinances, in conflict
herewith are hereby repealed..
SECTION FOUR: This ordinance shall be in full force and effect from
and after its passage, approval and publication in. the manner provided by law.
