ORDINANCE NO. 1143
AN ORDINANCE AMENDING SECTION 14.1210 OF THE MOUNT PROSPECT
MUNICIPAL CODE
WHEREAS, there are many service stations presently operating in
the Village limits that do not conform to the standards now set forth in
the Municipal Code of Mount Prospect, and
WHEREAS, the President and Board of Trustees of the Village of
Mount Prospect have determined that these existing service stations shall
be regarded as legal non-conforming uses.
NOW THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES
OF THE VILLAGE OF MOUNT PROSPECT, ILLINOIS:
SECTION ONE: Section 14.1210 Existing stations.
The provisions of the preceding section
of this article, excepting those regarding
gasoline buggies and other portable con-
tainers, shall not effect any existing
gasoline service stations or storage tank
installations in actual operation or use on
the day of the enactment of this article,
some to be a legal non-conforming use,
provided, however, that when any such ser-
vice station or tank installation shall not
have been used or shall have been abandoned for
a period of six months or more after this ar-
ticle becomes effective, the same procedure and
requirements of this article as applicable to
new stations or new tank installations shall
apply before such abandoned stations or storage tank
can be reoccupied or used for the sale or
storage of motor fuel.
SECTION TWO: All ordinances, or parts of ordinances, in conflict
are hereby repealed.
SECTION THREE: This ordinance shall be in full force and effect
from and after its passage, approval and publication in
the manner provided by law.
