HomeMy WebLinkAboutOrd 1194 03/21/1967 OPDINJ\NCE NO. 1194 AN OPDINANCE GHAN'1'ING VARIATIONS FOR rEOPERTY LOCATED ON THE SOUTh SIDE OF YENSING'1'ON ROAD BETlilF.:EN HILSliIRE AVENUE AND RAND ROAD ~vliliREAS, the Board of Appeals of the Village of Mount Prospect held a special meeting on January 6, 1967 at the hour of 8:00 p.r!!. in the Hount Prospect Village Hall pursuant to notice published in the f!;ount Prospect lrerald ou December 22, 1966; ar~ VJHEEEAS, the Board of Appeals of the Village of fJfount Prospect heard testimony presented under Case No. 67-1A pertaining to a request to operate a prototype restaurarlt which involved a land use variation, a building heiv,ht variation, and a sign or building height variation; and VJlIEflEAS, the Board of Appeals recommended to the Board of '1rustees of the Village of Mount Prospect to allow the variation on the use of the subject property for the use petitioned for; ar~ WHEREAS, the Board of Appeals recommended to deny the building height variation and to deny the building or sign height variation regarding the proposed silo; and VJ}llJ{EAS, the Judiciary Committee of the Board of Trustees of the Village of ~bunt Prospect subsequently met and considered the recommendations of the Board of Appeals under Case No. 67-lA; and v,T}iEPEAS, the Judiciary Canrnittee recor.mended to the Board of Trustees of the Village of filount Prospect to deny the variations as presented; and vvliliFU.::AS, the petitioner appeared before the Board of 'lrustees of the Village of Mount ITospect meeting of January 23, 1967 and at that time presented modifications to the requested variations; and V~S, the President and Board of Trustees of the Village of Mount Prospect have reviewed the rratter herein and have determined that the same is for the best interests of the Village of f,jount Prospect; NOW, 'TIiEREFORE, BE IT ORDAINED BY TEE PHESIDE!\J'l' A~[) BOARD OF '1'RUSTEES OF '1'HE VILLAGE or fiDUNT PEOSPECT: SECTION ONE: That the property being the subject matter of Case No. 67-lA, being legally described as follows: '1'he North four hundred (l~ 00) feet of the Vlest one hundred forty (140) feet of the East two hundred eighty (280) feet of that part of the Northwest quarter of the northeast quarter of Section thirty four (34), Tovmship (42) llorth, Pange eleven (11) East of the Third Principal f.1eridian lying Northeast of Rand Road, in Cook County, Illinois is currently zoned under the Zoning Ordinance of the Village of r.1ount Prospect as 1\-1 (single family residence) which zoning classification shall rerrain subj ect to the following g;ranted variations: (a) 'l'ilat the use of said property ma.y consist of the operation of a non-dri vein restaurant knm~n as Fanner Cooper's, Inc. as full~/ described in the pla.ns submitted under Buildinp; Permit #12817. '. (b) That at no time shall there be the sale of alcoholic beverages on these premises. (c) That the building set-back line for the main building shall be 39 feet. (d) '1'hat the set-back line for the structure referred to as a "silo" shall be 55 feet. (e) rI'hat the max:L'TIum height of the main building shall not exceed the rraximum of 31 feet 6 inches. (f) The max:imum height of the silo shall not exceed 3(3 feet 8 inches. (g) rl'hat the silo shall not contain on its surface or have attached thereto any materials that would take on the character of a sign. (h) That the structure referTed to as a "silo" sb.all be allowed as a variaticn runnir~ persor~l to the petitioner, Fanner Cooper's, Inc., and not with the land. (i) Tl~t the main buildiT'.g must maintain a one-floor only operation. SEC~ION T\~O: That all requirements of the Village Code be applicable except those variations as specified in Section One heretofore mentioned. SECTION '1'HHEE: 'I'hat the Director of Buildings of the Village of Mount Prospect is hereby directed to issue a building permit in accordance with the variations hereinbefore mentioned. SECTION FDUE: '1'hat the variations granted by this Ordinance shall be null and void ar~ of no force and effect whatsoever unless an application for a building permit pursuant to such variations is rode and construction commenced within one year of the date said Ordinance becomes effective. SECTION FIVE: This Ordinance shall be in full force and effect from and after its publication and approval in the manner provided by law.
