HomeMy WebLinkAboutOrd 2009 06/29/1967 ORDINANCE NO. 2009 AN ORDINANCE PE~ULATING PARADES BE IT ORDAINED PY THE PRESIDENT AND BOARD or TRUSTEES or THE VILLAGE or MOUNT PROSPECT, COOK COUNTY, ILLINOIS: Section 24.901. Definitions. (1) "Chief of Police" is the Chief of Police of the Villap:e of Mount Prospect. (2) "Villave" is the Vil1are of Mount Prospect. (3) "Parade" is ;-my parade, march, ceremony, show, exhibition, pageant, or procession of any kind, or any similar display, consistinR of 20 or more persons in or upon any street, park or other puh.1ic place in the Villap:e of r~ount Prospect. (4) "Parade Permit" i2 il permit as required hy this Ordinance. (5) "Person" is any person, firm,partnership, association, corporation, company or orpanization of any kind. Section 24.902. Permit Required. No person shall enpar,e in, participate in, aid, form or start any parade, unless a parade permit shall have been obtained from the Chief of Police ( or other appropriate official or body). (1) Exceptions. This Ordinance shall not apply to: (a) funeral processions; (b) students Roinp- to and from school classes or participating in educational activities, providinp such conduct is under the immediate rlirecti0n and supervision of the proper school authorit ies; (c) a governmen~al apency actin~ within the scope of its functi0ns. Section 24.903. Application. A person seekins issuance of a parade permit shall file an application with the Chief of P01ice on forffis provided by such officer. (1) Filing Period. An application for a parade permit shall be filed with the rhief of Police not less than 30 days not more than 90 days before the dat."e oS which it is proposer:! to conduct the parade. (2) Con~ent~. The application for a pararlp ~ermlt shall set forth the fl) llow ini-', inforr'i:l t len ; (a) The na~e, address and telephone number of the person seekinG to conduct such parade; (b) ]f the parade is proposed to be conducted for, on behalf of, or by an orpanization, the name, address and telephone number of the head~uarters of the organization, and of the authorized and responsible heads of such organization; (c) The name, address and telephone numher of the person who will be the pararle chairman and who will be responsihle for its conduct; : il II Ii II I (d) The date when the parade is to be conducted; (e) The route to he traveled, the startin~ point and the termination point; (f) The approximate numher of persons who, and animals and vehicles which, will sonstitute such parade; the type of animalst and description of the vehicles; (g) The hours when such parade will start and terminate; (h) A statement as to whether the parade will occupy all or only a portion of the width of the streets proposed to be traverser!; (i) The location by streets of any assembly areas for such parade; (j) The time at which units of the parade will begin to assemble at any such assembly area or areas; (k) The interval of space to be maintained between units of such parade; (1) If the parade is desifned to be held by, and on behalf of of for, any person other than the applicant, the applicant for such permit shall file with the Chief of Police a communication in writing from the person proposing to hold the parade, authorizing the applicant to apply for the permit on his behalf; (m) Any additional information which the Chief of Police shall find reasonably necessary to a fair determination as to whether a permit should issue. (3) Late Applications. The Chief of Police, where good cause is shown therefore, shall have the authority to consider any application hereunder which is filed not less than 10 days before the date such parade is proposed to he conducted. Section 24.904. Standards for Issuance. The Chief of Police sholl issue a permit as provided for hereunder when, from a consideration of the application and from such other information as may otherwise be obtained, he finds that; (1) The conduct of the parade will not substantially interupt the safe and orderly movement of other traffic contiguous to its route; (2) The conduct of the parade will not require the diversion of so great a number of police officers of the Village to properly police the line of movement and the areas contiguous thereto as to prevent normal police protection to the Villare; (3) The concentration of persons, animals and vehicles as assembly points of the parade will not unduly interfere with proper fire and police protection of, or amhulance service to, areas contiguous to such assembly areas; (4) The conduct of such parade will not interfere with the movement of fire-fighting equipment enroute to a fire; (5) The conduct of the parade is not reasonably likely to cause lnJury to persons or property, to provoke disorderly conduct or create a disturhance; (6) The parade is scheduled to move from its point of orlgln to its point of termination expeditiously and without unreasonable delays enroute; (7) any for The parade is not to be product, foods or event, private profit. held for the sole purpose of advertisinp and is not designated to be held purely Section 24.905. Notice of Rejection. The Chief of Police shall act upon the application for a parade permit within 3 days after the filinr thereof. If the Chief of Police disapproves the application, he shall mail to the applicant within 3 days after the date upon which the application was filed, a notice of his action, stating the reasons for his denial of the permit. Section 24.906. Appeal Procedure. Any person af~rieved shall have the rirht to appeal the denial of a parade permit to the President Rnd Board of Trustees. The appeal shall be taken within 3 days after notice of rejection. The President and Board of Trustees shall act upon the appe~l at the next re~ular meeting of the President and Board of Trustees. Section 24.907. Alternative Perwit. The Chief o~ Police, ~n denying an application for a parade permit, shall he empowered to authorize the conduct of the parade on a date, at a t;~e, or over a route different from the ndmerl by the applicant. Immediately upon the :issuance of a parade permit, the Ch.lef of Police shall send a copy thereof to the following: (1) Villape President. (?) Villa[e Manarer. (3) fire Chief. (4) Director of the !'epartment of Public \']orks. Section 21+.909. Contents of Permit. Each parade rermit shall state the foll.owing information. (1) Starting time. (?) Minimum speeo. (3) Maximum speed. (4) Maximum interval of space to he maintained between the units of the parade. (5) The portions of the streets to he traversed that may be occupied by the parActl? (6) The maximum lenpth of the parade in miles or fractions thereof. (7) Such other information as the Chief of Police shall find necessary to the enforcement of this Ordinance. Section 24.910. Duties of Permittee. A permittee hereunder shall comply with all permit directions and conditions and with all applicAhle laws and ordinances. (1) Possessinn of Permit. The parade Chairman or other person heading or leadin~ such activity shall carry the parade permit upon his person durinp the conduct of the parade. Section 21+.911. Public Conduct During Parades. (1) Interference. Ho person shall unreasonably hamper, obstruct or impede, or interfere with any parade or parade assembly or with any person, vehicle or animal participating or used in a parade. (2) Driving Throupht Parades. No drive of a vehicle shall drive between the vehicles or persons comprisinp a parade when such vehicles or persons are in motion and are conspicuously desipnated as a parade. (3) Parking on Parade Route. The Chief of Police shall have the authority, when reasonably necessary, to prohibit or restrict the parking of vehicles along a highway or part thereof constituting a part of the route of a parade. The Chief of Police shall post signs to such effect, and it shall he unlawfull for any person to park or leave unattended any vehicle in violation thereof. No person shall be liable for parkinv on a street unposted in violation of this Ordinance. Section 24.912. Revocation of Permit. The Chief of Police shall have the authority to revoke a parade permit issued hereunder, upon the application of the standards for issuance as herein set forth. Section Two: This Ordinance shall be in full force and effect from and after its passage, approval and puhlication in the manner provided hy law. AYFS: G NAYS: o PASSED this 29th day of June, 1967.
