HomeMy WebLinkAboutOrd 1188 02/21/1967 ORDINANCE NO. 1188 AN ORDINANCE AHENDING ARTICLE II, SECTION 8 OF VILLAGE PLAN - TREES wdEREAS, the Plan Commission of the Village of Mount Prospect held a public hearing on December 16, 1966, at the Ivlount Prospect Village Hall pursuant to Public Notice published in the fvlount Prospect Herald on December 1, 1966; and \Ai'HEREAS, the Plan Commission having heard all matters pertaining to the subject matter under Case No. 66-29P entitled "Amendment to Article II, Section 8 of the Village Plan - Trees"; and \:JHEfiliAS, the Judiciary Committee of the Board of Trustees held their regular meeting at the Hount Prospect Village Hall on January 13, 1967, and concurred in the Plan Commission's recommendation with regard to Case tb. 66-29P; and w}lliREAS, the President ard Board of Trustees of the Village of Mount Prospect believe the best interests of the residents of Mount Prospect would be attained by the passage of said Amendment; NQ\li, THEFEF'ORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF 'l'RUSTEES OF THE VILLAGE OF tfJOUNT PROSPECT, COOK COUNTY, IILllbrs ~ SECTION ONE: That Section 8 (Street Trees) of Article II of the Village Plan of the l\1unicipal Code of Hount Prospect, as amended, be and is hereby further amended by deleting the designated types of trees contained in line six of said Section and inserting herein the following allo~~ble trees, so that the said Section 8 (Street Trees) of Article II of the Village Plan of the tlJunicipal Code of Mount Prospect to be and read as follows: Street Trees; Street trees srall be planted throughout the entire subdivision. Such trees shall be planted in the parkways four (4) feet from the sidewalk, and shall be spaced not less than 30 feet nor more tl1an 50 feet on parkways abutting lots with a frontage of less than 65 feet and not less tharl 43-1/2 feet on parkways abutting lots that have a frontage of 65 feet. The trees shall be one of the following: Norway r.1aple, Red Maple, Sugar Maple, Hackberry, ~1ite Ash, Green Ash, Blue Ash, Tulip Tree, \:fuite Oak, Burr Oak, Pin Oak, Little-leaf Linden, Schwedler's Purple Maple, Crimson King Yaple, Horse-Chestnut, American Beech, Purple-leaf Beech, European Beech, r1aidenhair Tree, Noraine Honey-Locust, Northern Red Oak, Scarlet Oak, Red Oak, and Christine Buisman Elm, and shall be of a caliper of not less than 2 inches and the developer is to certify to the Village that said trees are free from disease under the State of Illinois Plant Inspection Department star~ards. The trees shall be transplanted stock and transplanting thereof rlaving been done within four (4) years from the time of purchase. rrhe Subdivider stall deposit with the Village Treasurer a sum of money sufficient to guarantee the installation and cost of street trees as required. TI1e rate per tree required to be deposited shall be detennined from time to time by Resolution passed by the President and Board of Trustees. Guarantee of the life of the tree shall be twelve (12) months from date of planting. Release of escrow funds may be obtained by the deposit with the Village rrreasurer of a written guarantee from the installing nursery II I ~. - 2 - for the replacement of those trees which may not survive one year. SEC'l'ION TWO: All Ordinances or parts of Ordinances in conflict herewith are hereby repealed. SECTION TEPEE: This Ordinance shall be in full force and effect from and after its passage and approval in the manner prescribed by law. AYES: 6 NAYS: 0 PASSED this 21st day of February, 1967.
