HomeMy WebLinkAboutOrd 2031 10/03/1967 ORDINANCE NO. 2031 AN ORDINANCE GRANTING A SIDEYARD REQUIREMENT VARIATION LOCATED AT 811 WEST MILBURN. MOUNT PROSPECT. ILLINOIS. WHEREAS, the Board of Appeals of the Village of Mount Prospect did meet on the 26th day of May, 1967 at the hour of 8:00 P.M. at the Village Hall of Mount Prospect and did hear Case No. 67-l6A pursuant to legal notice published in the Mount Prospect Herald on May 7, 1967; and WHEREAS, the Board of Appeals of the Village of Mount Prospect did hear a petition requesting a variation of the side yard requirements in order that the petitioner may erect a two-car garage on the property legally described herein; and WHEREAS, the petitioner's property is east of and adjacent to an easement 20 ft. in width presently used as an exit and entrance to the grounds of the Lincoln School; and WHEREAS, the Board of Appeals did refuse the request of the petitioner for this variation; and WHEREAS, the Judiciary Committee of the Board of Trustees of the Village of Mount Prospect did meet on September I, 1967 and considered Case No. 67-l6A and did determine that the public interests with respect to open space is herein guaranteed by the presence of the 20 ft. easement immediately west and adjacent to the petitioner's property; and WHEREAS, the Judiciary Committee of the Board of Trustees recommen- ded to the President and Board of Trustees that the variation requested under Case No. 67-l6A be granted; and WHEREAS, the President and Board of Trustees do believe that the granting of the variation would not be detrimental to the immediate neighborhood or to the residents of the Village of Mount Prospect and that the best interests of the residents of the Village of Mount Prospect will not be subserved by the granting of this variation; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT fu~D BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1. That the property being the subject matter of Case No. 67-l6A being legally described as follows: Lot 39 in Block C, Alfini's First Addition to Mount Prospect, Cook County, Illinois is currently zoned under the Zoning Ordinance of the Village of Mount Prospect as R-l (single family residence) which zoning classification shall remain subject to the variation granted herein: (a) That an extension to the existing one-car garage may be erected along a line not less than 16 1/2" from the west side lot line of the above legally described lot. SECTION 2. That all requirements of the Mount Prospect Building and Zoning Code shall be applicable except the variation noted in Section 1 heretofore mentioned. SECTION 3. That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for the erection and construction of a garage in accordance with the variations hereinbefore mentioned. SECTION 4. That the variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit pursuant to such variations is made and construction commenced within one year of the date said Ordinance becomes effective. SECTION 5. This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: 6 NAYS: 0 PASSED this 3rd day of October, 1967.
