HomeMy WebLinkAboutOrd 2036 11/21/1967 .c ORDINANCE NO. 2036 AN ORDINANCE GRANTING A SPECIAL USE WITHIN THE CHICAGO AND NORTH WESTERN RAILROAD DEPOT LOCATED BETvJEEN MAIN STREEr & EMERSON STRE1"T WHEREAS, The board of Appeals of the Village of Mount Prospect held a public hearing on March 31, 1967 at the hour of 8:00 P.M. at the Village Hall, 112 East Northwest Hif~way, Mount Prospect, Illinois with reference to Case No. 67-9A; and WHEREAS, said Public Hearinp- was held pursuant to proper legal notice; and WHEREAS, Case No. 67-9A was remanded back to the Board of Appeals for further hearing on August 25, 1967; and WHEREAS, Case No. 67-9A was a request for a variation allowing a special use for a drop-off and pick-up substation for dry cleaning and shirt laundry upon the southeasterly portion of the Chicago and North Western Railroad Depot located between Main Street and Emerson Street; and w1ffiRFAS, the petitioner presented a letter from the Chicago and North Western Railroad dated r~ch 6, 1967, a copy attached hereto as Exhibit "A", indicating that said petitioner's lease would be cancelled for this use if said sue created an increase of traffic congestion in the area surrounding the Railroad Depot; and 1t.1flEREAS, notice of any traffic congestion shall be processed throught the Manager's Office and forwarded to the President and Board of Trustees for their direction; and wrlliREAS, the Board of Appeals recommended the granting of the special use variation; and WHEREAS, the Judiciary Committee of the Board of Trustees did review Case No. 67-9A and concurred in the recorrrnendation of the Board of Appeals; and WHEREAS, the President and Board of Trustees of the Village of Mount Prospect deem that the recommended special use be granted; NOltl, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION 1: That the request for a special use variation for a drop-off and pick-up substation for dry cleaning and shirt laundry at the southeast portion of the Chicago and North Western Railroad Depot located on the Chicago and North Western right of way between Main Street and Emerson Street in the Village of Mount Prospect, Cook County, Illinois is hereby granted. SECTION 2: That the subject property under Case No. 67-9A shall remain in the 1-2 ( Railroad) District under the Zoning Ordinance of the Village of Mount Prospect subject to the special use allowed in Section 1 herein. SECTION 3: That all requirements of the Mount Prospect Building and Zoning Codes shall be applicable except the special use variation noted in Section 1 heretofore mentioned. .. SECTION 4: That the special use granted under this Ordinance shall be corne null and void upon direction from the President and Board of Trustees as per the terms contained in Exhibit "A" herein, based on whether the matter of traffic congestion resulting from this special use is considered increased by the President and Board of Trustees. SECTION 5: That the Director of Building and Zoning of the Village of Mount Prospect is hereby authorized to issue a building permit for the special use herein noted upon receipt of proper application for same under our existing Building Code. SECTION 6: That the special use variation granted by this Ordinance shall be null and void and of no force and effect whatsoever unless an application for a building permit is made and construction commenced within one year of the date said Ordinance becomes effective. SECTION 7: This Ordinance shall be in full force and effect from and after its passage and approval in the manner provided by law. AYES: 4 NAYS: 3 PASSED this 21st day of November, 1967. Moore Village Ranager Gentlemen : As you know, the Chicago and North Western Railway Company has an executed lease witb Mr. Alvin E. Spielman to operate a dry-cleaning drop-off shop in our depot in Mount Prospect. Our lessee has not cOt'llJenced this operation due to the Village objecting to the additional motor vehicle traffic that may arise especially during the morning and evening rush hours. The above matter was discussed with the Judiciary Co_ittee of the V i Hate Soard of Trus tees by ou r Mr. John McCormack and the under... signed on August 4, 1967, and it Is the Railway tompeny's desire that this matter again be submitted to them for approval with the understanding that if this leasing of space in out depot for the purpose stated above creates any additional traffic problem, the Railway Company is agreeable to terminate the lease upon written notification from your Mayor. When and if such a notice is re- ceived, we will terminate the lease in accordance wi th the terms thereof. by service of a 30 day written notice. This letter is submitted to you in duplicate and If the foregoing meets with the approval of your Soard of Trustees, please indlcate your acknowledgement and acceptance by signing the original of this letter, returning it to this office for attachment to our lease wlth Mr. Spielman.
