HomeMy WebLinkAboutOrd 2038 12/19/1967 ORDINANCE NO. 2038 AN ORDINANCE AMENDING ARTICLE II, CHAPrER 21 - FIRE UNITS BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That Article II of Chapter 21 of the Municipal Code of the Village of Mount Prospect, 1957) as amended) be and is hereby further amended in its entirety so that the new Article II of Chapter 21 shall be and read as follows: Section 21.201. Conflagration Hazard District Number 1 Established. For the purposes of lessening the possibility of conflagration or fire spread between buildings in close proximity) a conflagration hazard district, to be known as Conflagration Hazard District Number 1, is hereby established, within which Conflagration Hazard District certain types of construction are prohibited, as specified in Section 21.202 hereunder. All property lying within, or which hereafter nay be situated within, the Bl, B2, B3, B4 and I-I zoning districts as delineated in the Village Zoning Ordinances shall be construed as being in the said Conflagration lffizard District Number 1. All properties developed under special use ordinances for business uses or industrial uses shall be included in the Conflagration lffizard District Number 1. Section 21.202. Building Restrictions in Conflagration Hazard District Number 1. The following building restrictions shall apply as to all property lying within the Conflagration Hazard District Number 1 as aforesaid: (a) No building or structure of 4A or 4B wood frame construction, as set forth in the Mount Prospect Building Code and the BOCA Code, shall be erected hereafter, nor shall any wood frame addition be nade to any existing building or structure in the said Conflagration Hazard District Number 1. (c) No building or structure of 'I'ype 2C construction as defined and described in the BOCA Code, shall be erected hereafter, unless there shall be a 25 foot setback from all property lines. Said building or structure shall be no less than 25 feet from any point on the respective property lines. (b) No existing building or structure of wood frame construction II' shall be remodeled or substantially altered except where the rerrodeling or alteration shall serve to reduce the risk of conflagratiqn or fire spread. I I I I I I i I (d) No building or structure of 4A or 4B wood frame construction lying within the said Conflagration Hazard District Number 1 which has been darraged by fire or other cause to an extent of 50% or more of its value shall be repaired or replaCed, except by buildings or structures of other than 4A or 4B type construction. Type 2C construction may be repaired or replaced provided the 25 foot setback from all property lines is adhered to. (e) A building or structure of 4A or 4B wood frame or Type 2C construction lying within the said Conflagration Hazard District Number 1 which has been damaged by fire or other cause to an extent of less than 50% of its value may be repaired or replaced, provided the building or structure after repair or replacement shall not be increased to a size greater than its original dimensions, and further provided that combustible roof coverings shall not be used in the repair or replacement. (f) All buildings and structures within the said Conflagration Hazard District Number 1 shall have roof coverings of tile, slate, approved asbestos shingles or other roofings of a like grade, which rank as Class A or B in the "Fire Protection Equipment List" of Underwriter's Laboratories Inc., as defined and described in the pertinent Sections of the local Building Code, among which is Section 928 of the BOCA Code. (g) No building or structure of 4A or 4B wood frame construction, as defined in the BOCA Code, shall be moved from without to within the said Conflagration lmzard District Number 1, or from one lot to another in said Conflagration lmzard District or any other conflagration district. A building or structure of Type 2C construction may be moved to within the said Conflagration Hazard District Number 1 provided the 25 foot setback from all property lines is adhered to. . I (h) All Type 2C construction, as defined and described in the I BOCA Code, buildings or structures lying within the said Conflagration Hazard District Number 1 shall be limited to 2500 square feet and to one story in heig:l1t. (i) All exterior walls and roof of said building or structure are to be covered or constructed of non-flarrmable material; provided that this shall not operate to prohibit the construction of assessory structures as provided in Section 21.204 hereunder. Section 21.203. A building or structure shall be deemed to be within the Conflagration Hazard District Number 1 if any portion of the area of such building or structure is located therein. Nothing in this Article shall be interpreted to prevent the application of location limitations by the Village Zoning Ordinance. Section 21. 204 . The following assessory structures shall be allowed as exceptions within the Conflagration Hazard District Number 1: (a) Fences not exceeding the height limitations of the Village of JVbunt Prospect Zoning Ordinance. (b) Temporary platforms, reviewing stands, builders' shanties, and similar temporary structures erected for a limited time, as approved by the Director of Buildings. (c) Greenhouses not more than 15 feet in height erected on the same lot as, and accessory to, a store. (d) Wall sigps affixed flat against the building. j (e) Groun. d signs not exceeding the height and square foot requirement of the Sign Ordinance of the Village of Mount Prospect. I i Section 21.205. Conflagration Hazard District Number 2 Established. I For the purposes of lessening the possibility of conflagration or fire I spread to buildings in close proximity to Conflagration Hazard District : Number 1, a conflagration hazard district to be known as Conflagration 'I Hazard District Number 2 is hereby established, within which Conflagration Hazard District certain types of construction are prohibited, as specified I in Section 21.206 hereunder. All property lying within 200 feet of the II boundary line of any property situated within, or which may hereafter become situated within Conflagration Hazard District Number 1, shall be I construed as being within the said Conflagration Hazard District Number 2. Buildin., Restrictions in Confla ation Hazard Distr ct Number . ui d gs or s ructures of Type C construction within I the Conflagration Hazard District Number 2 shall be subj ect to the same I. sonditions as defined in Conflagration Hazard District Number 1. I 4A or 4B wood frame construction shall not be erected hereafter with the exception of the following assessory structures: (a) Temporary platforms, reviewing stands, builders' shanties, and similar temporary structures erected for a limited time, as approved by the Director of Buildings of the Village of t-10unt Prospect (b) Storm enclosures not exceeding 12 feet in height and not more than three (3) feet wider than the entrance doors which they serve. (c) Private detached garage buildings, which primary purpose is to house an autorrobile within the R-X and R-l Single Family Residence Districts, provided said garage building: (1) do not exceed 600 square feet in area nor 15 in height; and (2) floor construction providing fire resistance of not less than two hours; and (3) are located not less than five feet from the interior lot lines nor less than six feet from any other structure or building on the same lot. (d) Verandas, balconies, entrance porticos and similar perrranent structures on dwellings, not exceeding ten feet in depth nor proj ecting two feet above the second story beams, may be erected of 4A construction provided that same do not extend nearer than five feet from the lot line. I ! I I I I I I I I I I I I I I I I I I I Section 21. 208. Moved Buildings. No building or structure of llA or I 4B wood frame construction, as described and defined in the BOCA Code, shall be moved from without to within the said Conflagration Hazard Distric~ Number 2, or from one lot to another in said Conflagration Hazard District II Number 2 or any other conflagration district. A building or structure of Type 2C construction may be rroved to within said Conflagration Iffizard . District Number 2 provided the 25 foot setback from all property lines is adhered to. (e) Fences not exceeding the height limitations of the Village of Mount Prospect Zoning Ordinance. (f) Except as provided in paragraphs (a) to (e) herein, all exterior walls and roof of said buildings or structure are to be covered or constructed of non-flammable materials. Section 21.207. Roof Coverings. All buildings and structures within the said Conflagration Hazard District Number 2 shall have roof coverings of tile, slate, approved asbestos shingles, or other roofings of a like grade, which rank as Calss A or B in the "Fire Protection Equipment List" of Underwriter's Laboratories Inc., as defined and described in the pertinent Sections of the local Building Code, among which is Section 928 of the BOCA Code. Section 21.209. Damaged Buildings. No building or structure of 4A of 4B wood frame construction lying within the said Conflagration rmzard District Number 2 which has been damaged by fire or other cause to an extent of 50% or more of its value shall be repaired or replaced, except by buildings or structures of other than 4A or 4B type construction. Type 2C construction nay be repaired or replaced provided the 25 foot setback from all property lines is adhered to. A building or structure of 'l'ype 2C, 4A or 4B wood frame construction lying within the said Conflagration lffizard District Number 2 which has been damaged by fire or other cause to an extent of less than 50% of its value may be repaired or replaced, provided the building or structure after repair or replacement shall not be increased to a size greater than its original dimensions, and further provided that combustible roof coverings shall not be used in the repair or replacement. Section 21.210. A building or structure shall be deemed to be within the Conflagration Hazard District Number 2 if 1/3 or rrore of the area of such building or structure is located therein. ~ection 21.111. The provisions of the Village Zoning Ordinance relating to non-conforming uses and structures shall not affect the requirements of this Article. II Section 21.212. The Bureau of Fire Prevention, in conjunction with the Director of Buildings of the Village of Mount Prospect, shall prepare I or cause to be prepared a master rrap on which shall be accurately indicated, the area and boundaries of the Conflagration I-ffizard Districts established I by this Ordinance. Sarre shall be available in the office of the Village Clerk. A Zoning r.~ap showinp.:: the boundaries of the various zoning districts and special uses mentioned in this Article shall be a sufficient map for the purposes of this Section. Section 21.213. Penalty. Any person, firm or corporation violating any provision of this Article shall be fined not less than ten dollars ($10.00) nor more than five hundred dollars ($500.00) for each offense; and a separate offense shall be deemed committed on each day during or on which a violation occurs or continues. SECTION TWO: This Ordinance shall be in full force and effect from and after its passage. approval and publication according to law. AYES: 6 NAYS: 0 PASSED this 19th day of December. 1967.
