A RESOLUTION ACCEPTING THE OBLIGATION OF GENERAL flIAINTENANCE AND REF AIR OF THE
r1ETROPOLITAN SANITARY DISTHICT OF GREAT"ffi CHICAGO S,Al\JIT.ARY SE'tAJERS vlITHIN THE
\TILLAGE OF MOUNT PROSPECT

I\lHEREAS,l the representatives of the Village of Mount Prospect and the Metro-
politan Sanitary District of Greater Chicago have conducted several meetiIlgs
with r-espect to the general maintenance and repair of the T'letropolitan Sani-
tary District sanitar;y se-vrers within the corporate lirnlts of the Village of
Mount Prospect; and
\'iHEREA.s~ titles to said sewers are in the name of the r'1etropolitan Sanitary
District of Greater Chicago as collateral for an existing bond issue; and
tmEREAS,l all parties concerned are cognizant of the much needed continual gen-
eral naintenance and repair of said sewer system; and
\.IBEFEAS, certain funds are available for the general maintenance and repair of
same~ t'lhich funds are currently held by th.e Metropolitan Sa11itary District of
Greater Chicago; and
MiEREASll it is the consensus of those parties who undertook the study of the
feasibility of the Village of Mount Prospect Public '\rlor}~s Department W s main-
taining of said sewers that this Department could adequately do the general
maintenance and repair of said sewer system; and
t~HEREASll it is expected that the Metropolitan Sanita.:r,y District of Greater
Chicago, tr.roug..h its Board of Trustees II will approve a maintenance agreernent
during JI'Jarch>> 1970 $I allo1:ling the Village of Mount Prospect certain fu.'1ds to re-
imburse said Village for the general rraintenance and repair of the Metropolitan
Sanitary District sanitary sewers 'V'lithin the Village of Mount Prospect;
NOW, THEREFORE~ BE IT RESOLVED BY THE PRESIDENT AHD BOA.,~ OF TRUSTEES OF THE
VILLAGE OF MOUNT PROSPECT 1> COOK COUNTY, ILLINOIS:
SECTION ONE: That the Village of r,1omt Prospect d.oes :hereby accept the oblig-
ation for general m.aintenance and repairs of the Metropolitan Sanitary District
sanitary sewers within the corporate lirnits of' the Village of Mount ProSf::€ct on
a fiscal year basis commencing TI'lay 1, 1970 for a one-year period to be extended
yearly upon the mutual consent of the Villa.ge of lI''Iount Prospect and the Metro-
politian Sanitary District of Greater Chicago.
BE IT FURTHER RESOLVED that the Village of HOlmt Prospect accepts the proposed
budget extablished by the Metropolitan Sanita...ry District of Greater Chicago for
the general rraintenance a"'1d repair of the Metropolitan Sa.'1.itary District sani-
t~J sewers within the Village of Mount Prospect established at $37>>250~00 for
the fiscal year comrr.encing r1a.y 12' 1970 with the understanding that future
years W budgets will be detemined and negotiated based on experienceG
BE IT FURTHER RESOLVED that the Vil1at1= of Mount Prosepct a"P:,r'ees that if said
agreement is terminated after one year or prior to the complete reimbursement
from the rlfetropolitan Sanitary District of Greater Chicago for capital expend-
i tures the District will reiwburse the Village of Mount Prospect the funds
necessary to satisf~l the paid capital outlay,
BE IT FUR THER RESOLVED that nothing in this agreerrent shall be construed to
include major projects as defined by the Maintenance Division of the r-1etropol-
itian Sanitary District of Greater Chicagoll in which case the obligation re-
rrams with the Metropolitan Sanitary District of' Greater ChicagoG
SECTION TVlO: That this Resolution shall be in full force and effect from &"1.d
