RESOLUTION NO. 2-71
A RESOLUTION GRANTING AN EASEl'lJENT TO COM1VIONi,.JEftLTd EDISON COMPA1\JY
WBEHEAS, on February 25, 1971 Corrmonwealth Edison Company has requested
that the Village grant it a utility easement on property owned by the
Village and utilized by the Mount Prospect Public Library for parking;
and
t<JHE.HEAS, the easement would be used for underground cable and an above-
ground s1,'1i tching cubicle no larger than 25 square feet in size; and
VJBEHEAS, the Judiciary COrmJittee of the Board of 'Trustees of the Village
of Yliount Prospect did review this matter on March 11, 1971 at 8: 00
o? clock P .rli. at a public meeting conducted at the Village Hall; and
HHEREAS, Commoffi<lealth Edison Company operates a transfer station north
of Dempster Street between Busse and Algonquin Hoads withing the cor-
porate lirni ts of the Village of f'1ount Prospect; aDd
tVHEREAS, the Commonwealth Edison Company will install, pursuant to the
specifications of the Village Engineer, a five (5) feet w:.tde public
sidewalk parallel to the north line of Dempster Street along the entire
frontage of their property; and
"VVHEREAS, the President and Board of ~:rustees of the Village of Mount
Prospect have reviewed the matter herein and believe same to be in
the best interests of the Village of Mount Prospect;
NOH !I TIlli'REFORE, BE I'l' RESOLVED BY THE PRESIDENT AND BOAED OF TRUSI'EES
OF THE VILLAGE OF MOUNI' PROSPECT, COOK COilllTY, ILLINOIS:
SECTION ONE: That the President of the Board of Trustees of the Village
of f!Iount Prospect is hereby authorized to sign and the Village Clerk
of the Village of flIount Prospect is hereby authorized to attest the
"Grant of Easement!! attached hereto and made a part hereof as Exhibit
A, for an easement along the northerly and westerly property lines of
Village owned property (as shown upon Exhibit B attached hereto and made
a part hereof), which easement is legally described as:
The West five (5) feet of the South forty (40) feet,
and the North five (5) feet of the East one hundred
forty-seven (147) feet and the West ten (10) feet of
the North ten (10) feet all in:
Lot ei[!llt (8) in Clock four (4) in Busse and Wille's
resubdivision in Mount Prosnect in the West half (1/2)
of Section 12, township 41 i~orth, Range 11, East
of the Third ,rincipal f,1eridian.
SECTION TldO: That this Resolution shall be in full force and effect
from and after its passage and approval in the rnanner prescribed by law.
