A RESOLUTICN ACCEPTING THE OBLIGATla~ OF GE!\1ERAL MfuNTEl~Ai'JCE .AN'D PEP AIR OF
THE I'IlETROPOLIT.AN' S.AN'ITARY DISTRIGr OF' GREATER CHICAGO SANITARY SEJflERS vJITH-
IN THE VILLAGE OF MOUNr PROSPEGr FOR FISCAL 1971 - 72

~\[.HEREAS:I the representatives of the Village of' I'ijount Prospect and the IfJetro-
politan Sanitary District of Greater Chicago have conducted several meetings
with respect to the general maintenance and repair of the JVietropolitan Sani-
tary District sar.i tary sevlers 1^fithin the corporate limits of the Village of
Mount Prospect; and
14HEREAS! titles to satd sewers are in the narre the ~tropolitan Sanitary
District of Greater Chicago as collateral for an existing bond issue; and
WHEREAS J all parties concerned are cOf'1l.izant of the much needed continual
general maintenance and repair of' said sewer system; and
iATHEFE.AS, certain funds are available for the general maintenance and repail"
of sarr:e ~ ",Thich funds are currently held by the Metropolitan Sanita.ry Dis-
trict of Greater Chicago; and
WHEREAS, it is the consensus of those parties '[tIho undertook the study of the
feasibility of the Village of Mount Prospect Public \rlorks Department W s rnain-
taining of said sewers that this Department cov~d adequately do the general
maintenance and repair of said sewer system; a.'1.d
1;TBEREAS>> it is expected that the Metr'Opolitan Sanitary District of Greater
Chicago j througp i'l;s Board of Trustees!p will approve a maintenance agreement
during June ~ 1970 ~ allowing the Village Mount Prospect certain funds to
reimburse said Village for the p;pneral maintenance al1d repair of the ffetro-
politan Sanitary District sanitary sewers vlfithin the Village of Mount
Prospect;
NOtl ~ THEREFORE II BE IT RESOLVED BY 'lEE PRESIDENT AND BOPJID OF TRUSTEES OF THE
\lILLAGE OF MOUl\!T PROSPEGr II COOK COUNTY ~ ILLINOIS:
SEGrION ONE: mat the Village of ~lount Prospect does hereby accept the
'Obligationi'or generale-taintenance and repairs of the IvIetropoli tan Sanitary
District sanitary Se1ffers within the corporate limits of the Village of
Mount Prospect on a f:Lscal yem' basis comnencing May 1 ~ 1971 ~ for a one-year
period to be extended yearly upon the mutual consent of the Village of r,10unt
Prospect and the r1etropolitan Sanitary District of Greater Chicago.
BE IT FUR-illER RESOLVED that the Village of f'!Iount Prospect accepts the pro-
posed budget established by the TJIetropolitan Sanitary District of Greater
Chicago for the general maintenance and repair of the l\1etropolitan Sanitary
District sanitarJ sewers within the sillage of ]\lount Prospect established
at $37 11250.00 for the :f'iscal year cOrnrrEncmg r,1a;y l~ 1971$ with the unde:r>-
standing that futu..-ne years' budgets will be determined and negotiated based
on experience@
BE IT FURrBER RESOLVED that the sillage of ribunt Prospect agrees that if
said agreement is terminated after one year or pr-lor to the corrplete reinz...
bursement from the r1etropol:ltan Sanitar,y District of Greater Chicago for
capital expenditures the District will reimburse the Village of Mount
Prospect the funds necessarJ to satisfy the paid capital outlay.
BE IT FURIHER RESOLVED that nothing in this agreerrent shall be constl"Ued to
include maj or proj ects as defined by the Maintenance Di v'!sion of the i'fletro-
politan Sanita..""Y District of Greater Chicago $ in which case the obligation
remains with the T\'!etropolitan Sanita.."'Y District of Greater C'nicagoe
SECI'ION TWO: That this Resolution shall be in full force and effect from
and after its passage and approval in the manner prOld.ded by law.
