HomeMy WebLinkAboutRes 28-72 10/17/1972 RESOLUTION NO. 28-72 A RESOLUTION AUTHORIZING THE EXECUTION OF THE AGREEMENT FOR TOPICS PROJECT EHST-5003(61) WHEREAS~ the Village of Mount Prospect through its Mayor and Board of TTustees~ its Village Manager, and its Project Engineers have for some months planned the improvement known as the widening of Illinois Route 83 between Evergreen Street and Central Road; and WHEREAS, the certain teTffiS of an -:reSInent att hereto reflect what is best for both the citizens of the Village of Mount Prospect and the State of Illinois; and WHEREAS. the Mayor and Board of Trustees of the Village of Mount Pros- pect have ascertained that entry into this Agreement is for the best interests of the Village of Mount Prospect; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT, COOK COUNTY, ILLINOIS: SECTION ONE: That the Mayor of the Village of Mount Prospect is here- by authorized to sign and the Village Clerk of the Village of Mount Prospect is hereby authorized to attest the Agreement for TOPICS PRO- JECT EHST-5003(61) hereby made a part hereof and attached hereto to Exhib it 1. D., 19____ by and between the STATE OF ILLINOIS, acting by and through its DEPARTMENT OF TRANSPORTATION, hereinafter called the STATE and the VILLAGE OF ~10UNT PROSPECT, acting through its PRESIDENT AND VILLAGE BOARD, hereinafter called the VILLAGE; WIT N E SSE T H WHEREAS, the STATE and the VILLAGE in order to facilitate the free flow of traffic and insure safety to the motoring public is desirous of improving the intersections of Main Street (Illinois Route 83, Busse Highway, Elmhurst Road, FAS 128) at Central Road (FAS 127, CH 117) and Main Street (Illinois Route 83, Busse Highway, Elmhurst Road, FAS 128) at Northwest Highway (US Route 14, FAP 20, SBI 19) Prospect Avenue and Evergreen Avenue, VILLAGE section 44-C5, STATE Section 97-W&RS, Project EHST-5003(61) by making the following intersection improvements: I. FOR THE INTERSECTION OF MAIN STREET AND CENTRAL ROAD: A. Throat widen the east and west legs approximately 600 feet each leg to provide two (2) eleven (11) foot throu9h lanes each direction and a ten (10) foot left turn lane on each leg. B. Throat widen the south leg of Main Street an approximate 850 feet and the north le9 an approximate 500 feet to provide two (2) eleven (11) foot through lanes each direction and a ten (10) foot left turn lane on each leg. C. Curb and gutter as well as sidewalks are to be provided through- out the improvement. ~~OOu[ffi~u I; -2- D. Modernize the traffic signal and controller equip- ment. II. FOR THE INTERSECTION OF MAIN STREET, NORTHWEST HIGHWAY, PROSPECT AVENUE AND EVERGREEN AVENUE: A. Extend the left turn storaae lane on the south leg of Main Street at Prospect Avenue. B. Create a new left-turn storage lane on the north leg of Main Street at Prospect Avenue. C. Rephase the traffic signals giving continuous green time to the Northwest-Southeast movement during train blockage of the north-south movement. In addition, all other work necessary to complete the improvement in accordance with the approved plans and specifications shall be provided, which hereinafter shall be called the PROJECT, and; WHEREAS, the VILLAGE and the STATE are desirous of obtaining Federal par- ticipation in the cost of the improvement under the requirements of Federal Policy and Procedures Memorandum 21-18, Traffic Operations Program to Increase Capacity and Safety, (T. O. P. I. C. S.), dated May 12, 1972; NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The VILLAGE agrees, at its own expense, to make all surveys, prepare or cause to be prepared, plans, specifications and estimates, -3- to provide material inspection during construction, furnish resident engineering inspection during construction at the PROJECT site and cause the improvement to be built in accordance with the plans, spec- ifications and contract. The STATE will reimburse the VILLAGE for a portion of the preliminary and construction engineering as hereinafter stipulated. 2. The STATE agrees, after receiving acceptable plans from the VILLAGE, to receive bids and award the contract subject to the con- currance of the VILLAGE and the FEDERAL HIGHWAY ADMINISTRATION. The STATE agrees to pay the cost for contract construction subject to re- imbursement by the VILLAGE for its share of this cost as hereinafter stipulated. 3. The VILLAGE has passed a resolution appropriating sufficient motor fuel tax funds to pay its share of the cost of this PROJECT$ a copy of t...;hich is attached as "Exhibit A." Upon notification by the STATE of compl eti on of the PROtlECT, the V ILLAGE agrees to reimburse the STATE a lump sum amount for the PROJECT which represents the VILLAGE'S obligation incurred under this agreement. 4. The VILLAGE has adopted and will put into effect, prior to the STATE'S advertising for the work to be performed hereunder, an ordinance requiring that parking be prohibited within the limits of the PROJECT, a copy of whi ch is attached as "Exhi bit B. I! 5. The VILLAGE has adopted and will put into effect, prior to the STATE'S advertising for the work to be performed hereunder, an ordinance prohibiting the discharge of sanitary and industrial waste water into any storm sewers constructed as a part of this PROJECT, a copy of which is attached as IIExhi bit C. The VILLAGE agrees not to authorize or permit any operation, practice or encroachment which will change, impede or interrupt the orderly flow of vehicular traffic on the completed PROJECT and to enforce such traffic regulations and local ordinances as effect traffic operations thereon. 7. Prior to the STATE advertising for the work to be performed hereunder, the disposition of encroachments will be cooperatively determined with Representatives from the VILLAGE, the STATE and the Federal Highway Administration. The VILLAGE has adopted and will put into effect, prior to the STATE1S advertising for the work to be performed hereunder, an appropriate ordinance relative to the dis- position of encroachments and prohibiting, in the future, any new encroachments within the limits of the PROJECT, a copy of which is attached as "Exhibit D. II 8. The VILLAGE agrees to provide, prior to the STATEIS advertising for the work to be performed hereunder, approval of the plans and spec- ifications as prepared by resolution or letter. 9. The VILLAGE shall have all private utilities relocated, within the proposed PROJECT, at no expense to the STATE. 10. Upon completion of the PROJECT and so long as Main Street (Illinois Route 83), Central Road (FAS 124) and Northwest Highway (US 14) are used as State Highways, the STATE agrees to maintain or cause to be maintained the through traffic lanes, the left turn lanes, the painted medians, and the pavement markings and striping on these streets within the limits of the PROJECT. -5- 11. Upon completion of the PROJECT, the VILLAGE agrees to maintain or cause to be maintained the through traffic lanes, the left turn lanes, the pavement markings and striping and the painted medians on Busse Avenue, Evergreen Avenue and Prospect Avenue as well as all curb and gutter flags, sidewalks, manholes, catch basins, storm sewers, utilities and appurtenances not to be maintained by the STATE within the limits of the PROJECT. The VILLAGE will also maintain or cause to be maintained all traffic signals and will furnish the energy for the operation of all traffic signals. Such maintenance shall be in accord- ance with the Traffic Signal Maintenance Provisions, a copy of which is attached as "Exhibit E. II The STInE retains the right to control the sequence and timing of the traffic signals. 12. The VILLAGE agrees henceforth to maintain a technically com- petent traffic engineering unit within its governmental structure or to provide other means acceptable to the STATE and the U. S. Department of Transportation, Federal Highway Administration, for assuring proper maintenance and operation of the completed PROJECT. 13. The VILLAGE agrees to comply with all applicable Executive Orders and Federal Highway Acts pursuant to the Equal Employment Opportunity and Nondiscrimination Regulations required by the U. S. Department of Transportation. 14. The STATE agrees to provide contract construction administration, general supervision of the Resident Engineer and materials inspection and testing at the source, not including the inspection and testing of bitum- inous or portland cement concrete mixes. -6- 15. The parties hereto mutually agree that the division of costs shall be as follows: A. The VILLAGE agrees to pay the total cost of engineering, Item 15(b) subject to reimbursement by the STATE of fifty per-cent (50%) of the total engineering costs estimated to be $22,700.00. Reimbursement to the VILLAGE by the STATE will be in an amount equal to the STATE'S obligation for engineering costs to be credited to the VILLAGE'S unobligated MOTOR FUEL TAX Account upon completion of the PROJECT. B. The STATE agrees to pay all contract construction costs, Item 15(a) with partial reimbursement by Federal and VILLAGE participation. The Federal (TOPICS) share of these costs shall be 50.34 percent or an amount estimated to be $156,054.00. The VILLAGE'S share of the contract construction costs is 24.83 percent or an amount estimated to be $76,973.00. The STATE'S portion of the PROJECT shall NOT exceed $100,000.00. 17. The parties hereto mutually agree that failure on the part of the VILLAGE to fulfill the responsibilities covered in items 4, 5, 6, 7,11, 12, and 13 of this agreement will render the VILLAGE ineligible for Federal-aid participation in future highway projects for which they have similar responsibilities for as long as such failures remain uncorrected. 18. This agreement and the covenants contained herein shall become null and void in the event the contract covering the construction work con- templated herein is not awarded prior to January 1, 1975. 19.
