HomeMy WebLinkAboutRes 24-73 07/17/1973 RESOLUTION NO. 24-73 A RESOLUTION AUTHORIZING THE EXECUTION OF AN AGREEMENT WITH THE ELK GROVE RURAL FIRE PROTECTION DISTRICT WHEREAS. the Administration of the Village of Mount Prospect has reviewed the contract with the Elk Grove Rural Fire Protection District for the calendar year 1973; and WHEREAS. the said Administration has recommended to the Mayor and Board of Trustees of the Village of Mount Prospect the adoption of the said agreement; and WHEREAS. the Mayor and Board of Trustees of the Village of Mount Prospect have ascertained that entry into this agreement is for the best interests of the Village of Mount Prospect; NOW. THEREFORE. BE IT RESOLVED BY THE MAYOR AND BOARD OF TRUSTEES OF THE VILLAGE OF MOUNT PROSPECT ~ COOK COUNTY, ILLINOIS: SECTION ONE: That the President of the Board of Trustees of the Village of Mount Prospect is hereby authorized to sign and the Village Clerk of the Village of Mount Prospect is hereby authorized to attest the agreement for fire protection made a part hereof and attached hereto as Exhibit I. SECTION TWO: That the said agreement shall be retroactive to January 1, 1973, and shall be binding upon the parties thereto and their successors through Decem- ber 31, 1973. SECTION THREE: That this Resolution shall be in full force and effect from and after its passage and approval in the manner provided by law. Elk Grove Township, Cook County, Illinois, a Municipal Corporation, Elk Grove Township, Cook County, Illinois, (hereinafter referred to as the "First Partyll) and the VILLAGE OF MOUNT PROSPECT, Illinois, a Municipal Corporation, Wheeling and Elk Grove Townships, Cook County, Illinois, (hereinafter referred to as the T1Second Party"): WHEREAS, the First Party and the Second Party are municipal cor- porations organized under the respective statutes in such case made and pro- vided; and WHEREAS, the First Party is desirous of obtaining a contract from the Second Party for the purpose of providing fire protection and fire pre- vention services to that certain territory outlined in red on Exhibit A attached hereto (which area so outlined constitutes the entire and only area to be ser- viced by the Second Party for the First Party); and WHEREAS, the Second Party is willing to enter into a contract with the First Party to supply such services to said area; NOW, THEREFORE, IT IS AGREED, ACKNOWLEDGED AND UNDERSTOOD BY AND BETWEEN THE FIRST PARTY AND THE SECOND PARTY AS FOLLOWS: ARTICLE I: THAT for the period beginning January 1, A. D. 1973, to December 31, A. D. 1973, at 12: 00 midnight of said day the Second Party shall furnish all fire fighting, fire protection, fire prevention and emergency services by such volunteer and/or paid on-call or regular firemen available to the Second Party. as the Fire Chief of the Second Party shall determine, to the First Party for said area outlined in red on Exhibit A attached hereto. t, L - l:~/ 1'l11/3 I ARTICLE II: THAT for the period of time during which these Articles shall be in full force and effect First Party agrees to pay to and the Second Party agrees to accept as full payment for said fire fighting protection and fire prevention services and emergency services that amount of monies received as tax receipts collected in the year 1973 less all costs of running the said district including but not limited to all administrative legal salaries and other expenses incurred and less the amount of monies to be paid to the City of DesPlaines under a particular agreement for the year 1973 and the payment of said sum shall be made in the following manner, to-wit: A. The sum of $10.000.00 shall be paid upon the execution of the within Articles. B . The sum of $10,000.00 on or before April 1, 1973. C. The sum of $10,000.00 on or before July 1, 1973. D. The balance remaining after all expenses have been paid. ARTICLE III: THAT the Fire Chief of the Second Party shall have the sole exclusive right and responsibility to prescribe the manner and method of giving the alarm for fire or other emergency in the territory to be ser- viced by the Second Party for the First Party. ARTICLE IV: THAT the Fire Chief designated by said Second Party shall immediately upon arriving at the scene of any alarm or emergency (or such other officers as may be designated by said Second Party) have the sole and exclusive authority and responsibility to direct and control any and all fire fighting, fire protection. fire prevention and emergency operations carried on at such scene or scenes, and further, that any officers and/or firemen appointed by the First Party shall be subejct to the order and direction of the Fire Chief designed by the Second Party. -2- ARTICLE V: THAT all fire fighting, fire protection, fire preven- tion and emergency procedures conducted under the provisions of these Articles shall be under and in accordance with the regulations and ordinances, if any, of the Second Party. Furthermore, the First Party agrees that within ten (10) days of the execution hereof, it shall pass and approve ordinances identical in form and content to the ordinances of the Second Party which deal with fire fighting, fire protection, fire prevention, building construc- tion as related to fire safety. and emergency procedures. ARTICLE VI: THAT all expense of maintaining equipment, appara- tus, salaries, insurance premiums, and any and all other items of expense connected with the several services to be supplied by the Second Party to the First Party shall be supplied at the sole expense of the Second Party and that the only expense falling upon the First Party shaH be the payments schedules to be made hereinabove in Article II. The Party of the Second Part shall have the right to enter into another agreement to contract their obliga- tion under this Agreement, running with the Village of Arlington Heights, Illinois, for the servicing at that area west of Meier Road and also Meier Road if extended under this contract as per Exhibit A attached hereto. ARTICLE VII: THAT the First Party shall within seven (7) days of receipt of notice of annexation by a municipality of properties within its District forward a copy of said notice with the legal description contained therein, to the Second Party by addressing said copy of notice to the atten- tion of the Village Clerk, 112 East Northwest Highway, Mount Prospect, Illinois. IN WITNESS WHEREOF the Parties hereto have caused these Articles to be executed by their respective officers and affixed hereunto their respective corporate seals. -3- These Articles have been executed on behalf of the First Party pursuant to adoption thereof by a resolution of the executive body of said fi: First Party on the I r: ......... day of , A.
